Telemarketers are already devising ways to get around "Do Not Call" lists

This is to all of you that signed up for the "do not call" law. This week I received a card in the mail that looked alright — It said "vote for your favorite cola — Pepsi or Coke — and receive a complementary 12 pack" It didn't look suspicious — but for some reason I kept looking at it.

THEN I FOUND IT !! At the bottom of the card there is a VERY small statement. It is SO small it is hard to read—but here is what it says— By completing this form, you agree that sponsors and co-sponsors of this offer may telephone you, even if your number is found on a do not call registry or list"

This REALLY upset me and I just wanted all my friends to be aware of this way to get around the "do not call" law !! Just think how many people will send this in and their do not call registry will be NO GOOD !! The company's name is MARKET SOLUTION. Please send this to all your friends that signed up for "do not call". I think this is just one of what we will get in the future—so READ EVERYTHING before you SIGN AND SEND !! AND TELL YOUR FRIENDS ABOUT IT.!!!! PLEASE !!!

1. Right.
There's an exception to the "do not call" rule if you've ordered something from or made an inquiry of the caller in some time frame, I think it's three months.

So, our options are to spend a fortune on call blocking, caller ID, caller this and call that; or we can put our names on the stupid list and have to be wary for the rest of our lives about every single offer we recieve in the mail or online?

I know I'm in the minority, but I don't support the "do not call" lists. My local paper had an article saying that an estimated 2 MILLION people would lose their jobs because of the list. I'm the first to admit that telemarketing calls are annoying and they always call at the wrong time, but I rather say "no thank you" or even hang up the phone than think of that many people without work.

4. I'd be surprised in 20,000 people lose their jobs
Turnover in this criminal industry is so high anyway that the people who leave--because it's a shit job and most people fail at it anyway--will simply not be replaced. And the T'marketers may find the law to be more effecient for them, as they won't have to waste time and money on phone calls to people who hate telemarketers anyway. Their sale rate will probably go up, not down. And in any event, how much sympathy should I have for the footsoldiers of a crooked industry?

5. I have sympathy
Maybe it's because I'm currently unemployed, but a shit job is better than no job. Who am I to determine what is or isn't morally acceptable work? You are probably right that the few telemarketers that remain may have a better chance at getting sales, but a tremendous number of people will lose their jobs in the process. Personally, I have sympathy for anyone who loses their job. Clearly, this is not the most upstanding type of employment in the country, but how are we going to find new work for so many people, especially considering a large number are lower skilled and need to work unusual hours? I linked just the first couple news sites from google regarding the 2 million estimate.

U.S. prisoners have worked as Tmarketers in the past and right now many of my calls (I get about three a day) are from people with heavily Indian-accented English. I asked one woman where she was calling from and she was in India. I read recently that this is one of the newest industries to be outsourced overseas. Since I live in a Latino part of LA, I even get calls in Spanish, and I wouldn't be surprised if the callers were calling from Mexico.

7. Answering machine + Caller ID = ZERO Telemarketers
We use the answering machine for call screening. I literally have not spoken with a telemarketer in more than 4 years.

8. The law needs to be amended
to exclude this kind of thing.

The intent is to allow companies with whom you have done recent business or in whom you've expressed interest to call you. But wide-spread exempting of rights should be disallowed, and promotional offers that are designed to gather names for telemarketers should clearly and legibly state their purpose.

I bet this "Market Solution" company will find itself in a federal lawsuit soon.
