OK lounge, I need some of those famous vibes...
My son is 28, a motorcycles (Harley) mechanic who went to school for his training and is a really good guy. He is working hard at building his business and reputation and takes it seriously. Two weeks ago he was at his bosses house and rolled an ORV and was taken into the hospital because he was unconscious after the crash. Thankfully he had nothing broken, he did suffer a concussion but has made a full recovery. He has no health insurance and the charges so far are $1500 for the ambulance and the radiologist. There will be more to come. I am available to help him with these costs because I know how hard he works and I want to help.

So today a policeman showed up at his door and arrested him for operating an ORV under the influence, he had no idea he was in trouble. He had to be bailed out, he is mortified, and he faces more court costs and six points on his drivers license which will shoot his insurance through the roof. Apparently in Michigan this is the law and he did not have to give his permission to get a blood alcohol level because the fact that he is driving an ORV gives implicit permission. The arresting officer never read him his rights and he didn't receive a paper slip with his rights on it in the drunk tank either, which the other prisoners told him he was supposed to get.

Damn, this kid has worked hard and just starts to get his life together and then this. I guess all things happen for a reason......right?

I am sorry about the DUI...

I hope he will get his act together and not do that anymore.

I certainly don't want to sound harsh or uncaring...

But perhaps this was a wake-up call for him...

Driving under the influence is not a smart thing to do...

I am hopeful that he will not do that anymore...

And thank goodness he had no broken bones...

4. I said as much to him tonight
He said I didn't have to tell him because he was thinking the same thing. He really isn't a big drinker, and I would know because of my history. He just seems to be the one who gets caught, always has been. I hope he does settle down. Thanks for the vibes.

9. Some people are like that. Always the one getting caught...
Then there are jerks like myself but I digress. As someone else posted spend the cash hire a good attorney. Best investment you can make in you sons future. This isn't just a matter of guilt and innocence a good attorney can make it as if the arrest never happened.

Also let you son know in kind words this is his one big bail out anymore DUI's he is on his own... and mean it.

5. He was out in on a farm field with the only bike that was there
so not much chance of anyone else getting hurt. Thanks for the good thoughts.

3. First of all, and I cannot stress this enough:
Get a first rate attorney. Even if it costs you more.

Have your son write down as many details as he can remember-- especially if he was not read his rights.

Good luck... and I wish your son well. The world needs good Harley mechanics... especially these days!! :hug:

7. We think alike, those were my suggestions to him tonight.
He and his girlfriend were going home to write it all down and they will call a lawyer in the morning. He is both Harley and BMW certified and I hear he is very good, although I don't ride. Thanks for the solid advice.

14. That seems messed up
I understand reporting shootings & stabbings but there is (should be) a thing called doctor-patient confidentiality. Comvined with the fact that he was never read his rights, it sounds like he is being railroaded.

15. The way I look at it
he was drinking and he shouldn't have been so it's not railroading. I think not reading him his rights may have been a favor in a way. The policeman who arrested him kept apologizing and telling him he didn't want to have to do this but he had no choice. It was an oversight to be sure, but something tells me that once the policeman talked to my son he might have cut him a break.
