Who decides what jail you go to?

What crimes get you sent to county jail, to state prison, or to federal prison?

This is a purely academic question. :P

Misdemeanors or sentenced to one year or less - county jail
Felony state conviction - state pen (like Folsom)
Federal offense - federal pen like Leavenworth

9. When I worked in a jail it pretty much worked like this...

... and remember, every county is different, as are the judges that do the sentencing.

County jails are mostly used for holding throughout the trial process. The accused are there until they are sentenced. Once they are sentenced they can return to the jail depending on the sentence handed down by the judge. In my county's case, any crime that carried a sentence of less than two years usually stayed in the county jail. There are caveats to that though. A lot of our prisoners were from other state prisons due to over flow. If a state had too many (non-violent) prisoners in their prisons they would be shipped to our jail for a fee.

Any sentence that was over two years usually went to state prison. There were always exceptions to the rule, and judges have a lot of discretion, but that was usually the case.

Federal prison is a whole different ballgame. In most cases you have to break a federal crime to go there.

Basically you have Federal law, State law, and local city laws.

City laws, and some misdemeanor state, and lesser felonies go to county jail. Sometimes County lock up is used as a holding facility for the state.

The state prison takes violators of state laws

Federal prisons are reserved for violations of federal laws.
