1. Someone showed the prosecutor the actual cost in terms of legal fees and popular vote.

It's not cheap to try a celebrity for a minor charge when the celebrity can hire a legal team to rival OJ Simpson's.

Complete waste of time and money on the "investigation" although the sheriff said it was not a waste because we need to show children how bad drugs are.

If he'd have been less famous odds are good he'd be copping a plea about now. If he were black, he'd probably already be in jail over the event.

I don't think pot should be illegal, but I hate the double standard of our system a hell of a lot more.

2. What it boiled down to was that it was impossible to prove Phelps committed a crime

The Sheriff said during his press conference that Phelps never mentioned marijuana in his apology (something i noted a couple of weeks ago). Since the picture was very vague, and the witnesses / accused did not implicate Phelps, there was no case.

In a court of law, even though it may look like he is smoking pot out of a bong, it is nearly impossible to prove he is smoking pot out of a bong from that picture.
