DU attorneys, looking for free advice, someone hit my car in a parking

lot, ripped off my bumper, crushed a fender, the guy who hit my car was entering a roadway, no signal and appeared to be going straight, I was to his right and was intending to go right on the roadway, well as I was waiting for him to move so I could see if it was clear he proceeded right thus hitting my car, he stopped and came back but he claims he had his signal on, but his word is against mine, he was driving a Chevy Express van, a very long commercial van and my car is a 944 Porsche, police did come but would not make a report as it was on private property, the question is do you think that I will have a problem proving the van was at fault and are responsible for the damages?

4. yes, as a side note he was talking on his cell phone the entire time I

was to his right, about a minute, and not once did he look to his right, what if I had been a pedestrian or a kid on a bike? but again I didnt look at my watch at the exact moment he hit me so proving he was on his phone would be difficult.

you, then the accident is his fault. I would return to the location to see if there were any witnesses.

When making a right turn, you are supposed to be as far to the right as possible.

6. Colorado, and there were no witnesses, yes we exchanged insurance

info and I did call my carrier

7. Well it is difficult to prove but they will take both of your statements

and the one wo is most consistent will likely win. You must be emphatic that he did not signal, was not looking and was on his cell phone...they will ask him and likely he will have to acknowledge such and that will be in your favor that he was not being attentive.

11. at this point not much, adjuster came out today but he's 3rd party

his insurance company said it would take 30/60 days for determination
