Why Do Courts Fail To Do Their Job....Why Do They Just Slap The Hand.

Sadly my daughter hooked up with a guy who just happens to be on the National Sex Offenders registry and even sadder she had a baby who is now 2 which only makes thing more complicated.

He was convicted as a juvenile at 17 years old and sentenced to some sentence, I am unable to tell you that because the case is sealed and neither him,my daughter,his parent or the court can or will tell me and my wife.In fact it was in June we found out about this conviction. The only thing we know is he was ordered to register with the authority's weekly since he claimed he was homeless when he was 18,he has failed to do so.

Up until June he had 2 warrants for his arrest for failing to register,this is a Class C Felony punishable by 5 years and or $5000.00. I found his court records online and in each of those sentences the Judge suspended a sentence of probation along with a $500 fine...

As I said earlier he had two warrants issued for failing to register until my wife and I sought information from the local police when we found him on the registry. He had been convicted on 3 counts of rape of a child under 12 years old and the police and prosecutor were actually waiting to get current information on him to issue the third warrant for again failing.

Two weeks ago he was arrested during a traffic stop,taken to jail and held for five days waiting arraignment on the warrant,the judge at the arraignment released him to go home under the condition he check in daily with some program..

Well today he show ups for a court date hearing and the prosecutor had a family medical emergency to attend to so the judge heard the case set up a date for next Tuesday where she from what my daughter said she will likely suspend the sentence again with the condition he registers with the sheriffs department weekly his address.

My wife and I are frustrated as to when they finally throw the book at him,he is certain to go back to his defiant actions soon. He is not a financial contributor to the family unit he has been unemployed since he was caught stealing from his employer in February and hasn't look for work since, it is my daughter who bring in 15-20 hours worth of min wage $$ each week and $500+ in food stamps plus a friend who lets the two of them sleep in a garage and the granddaughter eats dinner sleep at her other grandparents house and our home two nights a week. His only interest to his daughter is to use her as a pawn so he doesn't have to be gainful in life. I have suggested places to work and a REF before we found out about his legal issues,I have since stopped.

So why is the law failing society here...what will it take for a judge to grab the brass ring out of his hand and tell him this gig is up time to pay a serious price?? I am planing on expressing my opinions to my district state legislator after next Tuesday when this issue is closed. Tell me where my concerns are not warranted!

Non the less frustrated. Tell me what you would do.


BTW Our daughter will not leave him..he is the best thing since Hawaiian punch cotton candy to her.

1. The honest answer is that no one wants to pay for enough prisons
We could endlessly debate which people should be removed from society and for how long.

The bottom line is that there's far more crime in this country than most people realize and that it would be prohibitively expensive to incarcerate all offenders, especially due to the "war" on drugs, which is another topic altogether.

I don't know what the solution is, I'm just attempting to explain the motivations of the decision makers.

2. Judges are human, and in no position to judge.
I don't want to get all Biblical here, but no man, no peer, can be my judge. Nor can I be his.
But that's where judges find themselves.
They're human, subject to whim, collusion, bribery, blackmail, boredom, norms, mores, reputation, age, etc.
Some are in no better moral shape than those who stand before them.
Money changes things. It can impress, buy, elevate and motivate judges to do all sorts of nasty things.

3. I have no answers. I am just so sorry to hear about all of this.
It scares me as any one of our daughters could be yours. They are so vulnerable to predators.


Good luck sorting this out. Take care of yourself as this seems so incredibly difficult.

4. Call the prosecutor.
Minimally, I'd go behind your daughter's back and contact the Prosecutor's office; ask what you can do to make sure that he gets remanded and give them whatever information they might be lacking. They'll have questions that you might be able to answer or facts you can provide that they may not know...even if those facts are hearsay or inadmissible, they then know what to go find admissible evidence of.

I've never met a prosecutor that didn't like to win...such a reach out is an offer to potentially hand them a win on a silver platter. You might end up having to issue an official statement or testify if you intend to see this through...in which case your daughter, Cotton Candy and his family are going to know that you fucked Cotton Candy into a jail cell. Are you able to deal with the fallout of htat.

5. my first thought would be to protect the child
Is child protective services involved? If it were me, I think I would meet with the other grandparents and try to work out a custody arrangement with blessings of a case work -- that will keep the young one safe and away from the perv. I do not see how CPS could allow a child contact with a convicted child rapist.

Your daughter is another matter. If you get involved, you are likely to alienate her. That's why I suggest getting some lawful custody arrangement of the child so that your daughter can't just disappear with her and him. Or some other awful alternative.
