Jury nullification played a significant role in ending alcohol prohibition. Today the courts make a big deal out of making potential jurist agree to apply the law as it is written as a way of doing away with jury nullification.
But Massachussets is different in that their Constitution addresses jury nullification which allows for the people to make a judgement on the laws themselves which is what jury nullification was all about. Can someone address this statement and if it has ever been used in to say that the prohibition laws of cannabis are not just?
There is a big movement in Massachussets for the towns to go soft on cannabis possession by issuing a ticket instead of calling for a criminal trial and record much along the lines of the long standing laws of Ann Arbor, Michigan and the recent laws of several towns along the North Shore outside of Chicago.
