understanding of his faculties than the guy who served him all those drinks ...
In the latest attempt to paint an issue in the "frivolous lawsuit" vein, a local (WTAM 1100 Cleveland) morning host was talking with a lawyer/something like that about a pending lawsuit. A dancer at a bar was involved in an accident after work, and now is suing the employer for making her drink too much.
Of course, the Right-Winger will never give out the full details of the case, but will generalize and simplify it to make his RW talking point.
So, he and the "expert" are distilling it to the basest points - that the "victim" suing is also the perpetrator. blah blah blah ...
Something I get from this is that the RWer is saying that the person serving the drinker is not able to know whether or not the drinker had too much to drink.
Hmm ... doesn't alcohol impair your faculties? How many times have you heard of someone being told "I think you've had too much to drink." and the drinker getting belligerent and saying he's "perfectly fine" ... and then you hear the next day what this inebriated person did on the way home?
So, an unintoxicated observer is less able to tell when someone's drunk? Especially when the "unintoxicated observer" is the one having sold the drinker all those drinks all through the night?
The logic escapes me ...
