At this time, no charges have been filed in the shooting and the case is being referred to a Harris County grand jury
Texas law allows this. Assuming the media has the story straight and there are no other factors, the resident will walk and will have civil immunity also.

A Lubbock homeowner shot and seriously injured a suspected burglar who was trying to kick in his door Monday afternoon.
The homeowner called police shortly before 2:30 p.m. to report somebody was trying to gain entry into his house in the 3100 block of 45th Street, Lt. Neal Barron said.
a knocking sound at his front door and then the sound of his back door being kicked in. The homeowner opened the back door, confronted the suspect in his backyard and shot him with a shotgun.

Authorities didn't anticipate any charges against him.

Authorities were working to file charges against the burglary suspect, who was being treated at University Medical Center for serious injuries. They weren't believed to be life threatening.
Officers were working late Monday afternoon and into the evening to possibly connect the attempted break-in with others in the area. They believe several other suspects fled the scene after the shooting.
Burglary remains a high-risk occupation. I wonder if the other suspects learned the object lesson.

A man in a ski mask was shot by a resident after he forced his way into an Indio home Saturday night, police said.
The suspect fled the home with a gunshot wound, the weapon and an undisclosed amount of money after he confronted the residents, a couple in their “60's or 70s,” Indio Police spokesman Ben Guitron said. The couple was transported to a hospital with minor injuries.
“They were mostly shaken up,” Guitron said.
Police responded to the home at the 48-000 block of Andorra Street around 8 p.m., Guitron said.
The suspect allegedly entered the backyard through a side gate and smashed the rear glass sliding door, Guitron said. The suspect ordered the residents to lie down on the floor, began searching the residence, then scuffled with the husband, Guitron said.
During the scuffle, the wife obtained a 38-caliber handgun and shot the suspect once in the upper torso, according to evidence the police gathered, Guitron said.
The suspect disarmed the wife and was encountered by a neighbor who heard the commotion, Guitron said.
The suspect fled in a waiting vehicle, described as a red Ford Mustang with a black top. A partial plate of 5PA was reported, Guitron said.
If she shot him in the upper torso with a .38 he will be checking into a hospital really soon, unless he has already died and not been found.
