A DGU That Wasn't Reported To Police.

A few days ago lady of my acquaintance used her gun to prevent herself from being robbed. She has a small pizza place and does her own deliveries during the week. (A couple of helpers keep things going while she is making a run.) The address turned out to be an unoccupied home (No one lived there) address and a guy tried to rob her. She has a Texas CHL (Concealed Handgun License). The situation at the address had put her on alert. She practices situational awareness. She was ready and pulled her gun when he began the robbery attempt. He retreated and she got back into her vehicle and left.

She did not report it to the police. Here is her reasoning:

No Evidence. Even if the guy was caught, it would be her word against his.

Not a good decription. Her description of the guy was too general to be of use to the police.

Expensive to her/Take too much time. She needed to get back while the pizzas were hot and could be put out on the line.

Useless anyway. Even if the guy was caught and arresed, he would be back on the street before the arresting officer finished the paperwork.

1. All bad reasons not to report the crime.

She could have easily reported the incident after her shift. The guy could pull this again or could threaten other nearby businesses. Even if it is impossible to catch the guy, reporting it may cause the police to drive through the area more often and prevent future occurrences. Too bad she wasn't a good enough citizen to do the right thing.

If for no other reason than to protect myself from a charge of brandishing.

In the event that the person against whom you were defending yourself calls 911 claiming some whackjob pulled a gun on him without provocation, or a witness calls to report a man with a gun, it's good to be able to show that you took the initiative at the earliest opportunity to inform the cops; shows you don't think you did anything wrong.

Are you saying that she should have killed the robber? That may indeed have been her civic duty. After all, that would have preserved the evidence as the dead crook would be there next to his weapon. He likely already had a rap sheet (And I don't mean music.)that would have supported her story. And her story would be the only one being told. Maybe she should have fired.

Oh, I see. You think filing a report would have stopped him. Please explain how that would have stopped the criminal.

Besides, in some places, it is against the law to fail to report a crime.

IIRC, California is thinking of passing something like that.

How many of us drop by the police station to read what happened the day before?

All pizza delivery people I have ever talk with are well aware that they are prime targets for robbery. The big chain pizza places even have educational videos about how to act during a robbery. (I don't think much of them as they seem designed to prevent a lawsuit more than anything else. But that is just my opinion.)

Yes, he will try it again. But he would have done that anyway.

Even if they don't catch him this time, they might the next time. And sell the pizzas to the responding officer.
