Unbelievably huge ruling on MMJ from 9th Circuit Appeals

The Constitution outlined the granted powers of the federal government. It was implicit that those powers not granted by the Constitution would necessarily remain with the States. But just to make sure, the Bill of Rights included the 10th amendment to make it explicit. The federal government used the Commerce Clause of the Constitution to enforce a total prohibition of cannabis. This ruling says that the states can have Medical Marijuana and the federal government can no longer enforce the prohibition of cannabis for medical purposes.

This has huge implications and I suggest you read the comments at Cannabisnews to gain perspective on the importance of this ruling. Please advance this news to every messageboard possible. It will bring tidings of great cheer to many. Reason and justice have prevailed. It is absolutely a huge decision.

Given the 9th Circuit's record in theh Supreme Court, I will not be surprised if this is overturned. Sad, but likely.

That the federal government's use of the interstate commerce clause of the Constitution to regulate activity that is neither commerce nor interstate is unconsitutional. A person who builds a homemade machine gun from scratch and neither sells it nor transfers it across state lines cannot be prosecuted by the federal government if the person lives in the 9th District.

9. I had lost track of this

I think this is from the Justice Department saying that homegrown pot that was used for yourself or a sick person in your care was DEA territory. The DEA has interstate authority.

I find it hard to believe that SCOTUS can override what is clearly non-interstate. It can be argued that large farms are for interstate and seized, but the MMJ grown by the sick person and smoked/injested only by the sick person is in no way interstate.

Although the way SCOTUS has been going they will probably rule the seeds the plants came from are interstate.
