Defensive Gun Uses - January 2004.
1 - Feel free to add any pertinent stories to this thread by replying to this message. In order to be considered pertinent, stories should have taken place within the month in the title.

2 - Please direct your comments to the story, rather than attacking the person posting the story or any person responding to the story. In accordance with DU rules, any messages that appear to be personal attacks against another DU-er or violations of any other DU rule will be reported to the moderators.

3 - If you object to these guidelines, do everyone else a favor and go to another thread. Suggestions on the other hand are welcome.

4 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive. You will likely recieve some. Multiple links may help to keep the focus on the message, rather than the messenger. The whole idea is to see how many we can find at mainstream sources. If you find something from a questionable source, back it up with as many links as possible.

5 - Since this thread is a monthly summary, posting a story in this thread that also appeared in a daily "Guns In The News" thread will NOT be considered a dupe.

6 - Since this thread might be kicking around for a month, lets keep the flames and whatnot outside this thread. We are all or nearly all (with respect to teen age folks) adults and should be able to act civilized in at least 1 discussion a month with people we disagree with.

"A southeast Houston convenience store owner shot an alleged robber Tuesday afternoon, police told News2Houston."

"Investigators said a man walked into the Lawndale Food Mart, 5545 Lawndale, around 12:45 p.m. and tried to rob the owner. The suspect was armed with a knife. The owner then pulled a gun and shot the man, before he could get to the money."


""(The suspect) charged him with a knife behind the counter and attempted to rob him. It was an attempted robbery," said James Rachel, with the Houston Police Department."

"A Hill District man was shot and wounded by a clerk while trying to rob a Webster Avenue grocery store, police reported."

"A clerk at Ann's Market shot Joshua McKenzie, 18, after he pulled a silver handgun Friday night while he and another man were trying to rob the store, police said. Police said McKenzie is expected to survive his injuries. He was to be arraigned yesterday at UPMC Presbyterian hospital, Oakland, on robbery and firearms violation charges."

"(January 4, 2004) — CLIFTON SPRINGS — Ontario County sheriff’s deputies said a man is recovering from facial injuries after he was shot by a homeowner early Saturday."

"Deputies said a resident of 1294 King Road called 911 to report a burglary in progress after hearing glass break and seeing someone outside the home with a flashlight at 2:19 a.m."

"While the caller waited for deputies to arrive, the suspect attempted to lift a rear window to gain entry into the home."

"A man inside the house got a .22-caliber rifle from his bedroom and fired three rounds through the window, deputies said. The suspect, who was struck in the face by one round and numerous glass shards, was found on Route 96, they said."

"A Columbus mother grabbed a gun and defended her family against armed robbers. Columbus police say four juveniles with a gun kicked in the door of a home on North Roys Avenue near West Broad Street early this morning. A mother in a bedroom fired on the robbers to defend herself and her two young children. One suspect was hit in the buttocks. He dropped his gun and all four fled."

"Less than ten minutes later, police got a call from a home on North Wheatland Avenue on a report of a shooting. Police found the four and determined they were the robbers from Roys Avenue."

5. Shooting puts law to a test - IL
A College of DuPage football player who prosecutors said fired a fatal bullet at a fellow student in Lisle won't face murder charges because of a state law that allows a resident to defend himself against a home intruder.

Brian W. Hall, 18, and three co-defendants appeared in court Friday for the first time since prosecutors approved charges in this week's shooting at Benedictine University....

...But Hall, formerly of North Chicago, faces the least charges despite being accused of shooting Miller. Prosecutors charged Hall, a defensive back, with two misdemeanors for not having a valid firearm owner's identification card.

DuPage County State's Attorney Joseph Birkett said Hall was justified under the state's "defense of dwelling" statute, which allows residents to use lethal force, if someone breaks into their home, to prevent an assault.

" Police said the homeowner, whose name has not been released, told officers that he and his wife heard a knock at their front door about 8:30 a.m. They found two Hispanic teenage boys at the door who said they were looking for the man's grandson."

"After being told the grandson was not at home, police said the two came back a second time, but this time the homeowner was armed with a gun when he answered the door."

"The same two male Hispanic teens forced their way into the residence. One of them was armed with a handgun. The (homeowner) retreated and took cover behind a chair where he does exchange a couple rounds of fire," Sacramento Police Department Sgt. Justin Risley said."

12. If you want to play that game
Then you really ought to consider whether or not the assailant who was armed with a gun had obtained the gun legally. I'll wager that in at least 95% of these cases the answer to that question would be no.

The attempted devaluation of a DGU by saying "defense against a gun" seems to be rooted in a magical thought that if we could just click our heels together and say "There's no place like home" enough times that guns could be un-invented or at the least all guns presently in circulation or that might be manufactured in the future could come under such strict control that criminals couldn't get them.

I'll believe that fairy tale when the black market for heroin dries up permanently.

"One of two intruders involved in a shooting at an apartment earlier this week is out on bond, but faces possible kidnapping, burglary and menacing charges as a result of the break-in. Grand Junction police say Claudio Baca and his yet un-named companion broke down the door at 517 28 1/2 Road Tuesday afternoon. A police report says Baca was looking for Jessica Stauter because the woman owed him money. Stauter stayed at the apartment Monday night but left earlier in the day. Resident Joseph Moyano heard his apartment door being kicked open. He retrieved his handgun and went to his bedroom door. He ordered the men to leave. Instead the intruders backed Moyano into his bedroom. When he tried to call police, the un-named intruder knocked the cell phone from Moyano's hand, while Baca tried to grab Mayono's gun. The gun went off and the bullet hit Baca's companion."

...The homeowner, whom police declined to identify, told detectives
he had just come out of the shower shortly before 1 p.m. when he heard
the back door being forced open.

The homeowner, who is licensed to possess firearms, confronted
the burglar and shot him in the shoulder, according to police....

...Stephen P. Callinan, 37, of Somerville was being treated at
Massachusetts General Hospital and was expected to be charged with
breaking and entering, police said. Police did not say whether
Callinan was armed.

The homeowner was questioned by detectives for several hours
yesterday at the Somerville police station and allowed to leave. He
later met with detectives at his home. Police declined to say whether
they are considering charges against the homeowner in connection with
the shooting.


In most states this would be clearly a lawful act of self-defense based on the information presented here. Massachusetts law is unusual in that regard and similar to England and Wales - You have to exhaust every possible means of escape from a threat before you can legally apply deadly force in your own defense.

In order to fend off likely criticism I'd like to note that the Boston Herald has a reputation as a conservative-leaning newspaper. This incident was not mentioned in the more liberal Boston Globe AFAIK.

"Shortly after police were called to the scene at the Casa Vallarta restaurant, two men in a white pickup truck opened fire on an officer who tried to pull them over, Des Moines police Sgt. Jeff Aldrich said. The officer was not hurt."

"Other officers then chased the truck until one squad car rammed into the fleeing vehicle. The officer in that squad car was treated and released for injuries suffered in the collision."


"The suspects then fired on police as they ran to a nearby apartment complex, but surrendered after officers shot and wounded them, Aldrich said. Their injuries were not life-threatening, he added."

One grand jury determined that Central Precinct Officer Brian Hubbard was justified in firing at Jose Angel Padilla of Yakima to save the life of a woman whom Padilla was threatening at Portland's main bus terminal on Jan. 3.

Hubbard, 38, fired a single shot from about 25 feet away using an AR-15 rifle, striking Padilla once. Padilla, 22, died from a single head wound, an autopsy found.

""They were asking him, 'Do you have a knife?' He had his hand underneath her throat, pulled it out, displayed the knife clearly to the officers, and put it back beneath her neck," Chief Derrick Foxworth said Tuesday. "I don't think there was any doubt in anyone's mind that the suspect was going to take that woman's life.""

"Hubbard fired one shot at 7:24 p.m., three minutes after the first 9-1-1 call came in, Sgt. Cheryl Robinson said."

Not enough info on the second one, IMO.

TALLAHASSEE, Fla. (AP) - Baltimore Ravens cornerback Corey Fuller exchanged gunfire with an intruder outside his home early Wednesday.

Fuller and a house guest went outside to a car when they were confronted by the gunman at about 2:30 a.m. The man chased Fuller back into the house and then fled after about 20 shots were exchanged, police said. No one was injured.

Fuller, whose younger brother, Fred Bates, was shot to death at age 18 in 1992, offered a $10,000 US reward for information leading to an arrest.

"I've already lost one son," said Fuller's mother, Alice Bates. "I don't want to lose another one."
