NRA wants Indiana lawmakers to ban employers from gun-related questions

INDIANAPOLIS — The National Rifle Association has targeted Indiana’s “parking lot” gun law, saying employers are willfully violating the 6-month-old law that prohibits them from banning weapons on company-owned parking lots.

The NRA has asked its members to contact Indiana lawmakers to urge them to support new legislation that would allow employers to be sued if they require applicants to disclose information about gun ownership or require employees to reveal if they have weapons or ammunition in their cars.

1. How are employers protected against liability if a third party is injured on the

employer's property as a result of the employee's weapon?

2. Why is that even a question?

The same way they are covered if an employee, vendor, or customer would run over someone with their car.

Guns and their rare but possible consequences are not exdcluded from normal blanket liability insurance.

3. My state limited liability

for employers when they enacted the guns in cars legislation. This was the main reason big companies had a policy to begin with...liability that is. When a work place accident or incident occurs, the first thing asked by both regulatory agencies and insurance companies is if there is a company policy related to the accident/incident. If there isn't it is easier to assess liability on the employer. The state should recognize this and deal with it.

4. There's a twist there

Virginia Tech failed to protect its students. They prohibited students the Commonwealth of Virginia entrusted with a concealed weapons permit from protecting them selves.

The university is shielded from suit by sovereign immunity.

5. IIRC, sovereign immunity is reserved for government

or public facilities. It doesn't extend to private business or individuals, no?

Makes it easier for those in their ivory towers to maintain ideological purity.

There was a work place shooting in Louisville printing plant some years ago. It had a gun-free company policy and contract plant guards. Victims sued the employer for failing to protect them. The employer sued the security company because its minimum wage unarmed guards ran away rather than rush in to confront the shooter.

7. The same way they are if they use a pipe, car, gasoline bomb, nail gun, etc to hurt someone.
