For some reason, officers didn't believe teen's story that somebody shot at him and then he found a gun

Boston Police report that officers investigating what sounded like two gunshots on Annunciation Road around 11 p.m. yesterday found a guy on Ruggles Street "walking rapidly away" from the scene and repeatedly looking back over his shoulder:

Officers approached the suspect to further investigate the incident and to determine whether or not the suspect was involved. When asked about the gunshots, the suspect stated, "Yeah. I think they were shooting at me and I found a gun." A pat frisk of the suspect enabled officers to locate and take possession of a loaded firearm which the suspect was carrying. A search of the area enabled officers to locate a spent round from the weapon taken off the suspect.

Tarrell Lymon, 18, was charged with unlawful possession of a firearm, unlawful possession of ammunition and discharging a firearm within 500 feet of a dwelling.

I'm curious though - if he hadn't mentioned 'finding a gun', would they have had a legal reason to pat him down?
