Appeals Court Says Retired Prosecutors Can't Carry Guns,
The Appellate Division on Monday delivered some bad news to former assistant prosecutors and deputy attorneys general who want to carry handguns: They can't.
A three-judge panel said a state statute that allows retired law enforcement officers to carry handguns applies only to retired police officers and detectives, not to lawyers formerly employed as county or state prosecutors.
Nor does the federal Law Enforcement Officers Safety Act of 2004 create a "separate route" for retired assistant prosecutors and DAGs to get carry permits, the judges held in Matter of the Application of Casaleggio, A-4924-09.
The panel upheld a Passaic County judge's denial of a permit to Giles Casaleggio, a retired assistant prosecutor and DAG and now an assistant professor of criminal justice and legal studies at St. John's University in Staten Island.
