GUNS IN THE NEWS--March 4, 2004

Please try to adhere to the following voluntary guidelines, in order that we can have an orderly discussion of gun-related news topics:
1 - Feel free to add any CURRENT stories to this thread by replying to this message. In order to be considered current, stories should have been originally posted on the Internet within the previous 24 hours, or provide follow-up to a story that was previously posted on the J/PS board. On Mondays (since many people do not log in to DU over the weekend), stories can be posted from Saturday, Sunday, or Monday.
2 - Both pro-gun and anti-gun stories, editorials, and press releases are welcome in this thread, as long as they're current. Please do not post links to items from a few years back that support your position.
3 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) or intentionally pro-gun or pro-control sites (such as the NRA or the Brady Campaign) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive.
4 - Do not change story titles. In other words, if the Oskosh Gazette's web site runs a story titled "Two Killed in Holdup", the title of your message should read "Two Killed in Holdup". Don't change it to "Gun Owner Kills Two People", or anything else that changes the meaning of the story.
5 - If it's not clear from the title where the story occurred, add the city, state, or country in parentheses after the title.
6 - The person adding a news story to the "GITN" thread is allowed (and encouraged) to comment on that story, indicating their position on the topic being discussed. These comments can appear either at the beginning or end of the post; if possible, place comments in a different typeface so readers can separate the comments from the story. Others who wish to comment on a posted story can do so by replying to that story; this allows other readers to follow the comments by scrolling through the subthread.
7 - Please direct your comments to the story, rather than attacking the person posting the story or any person responding to the story. In accordance with DU rules, any message that appears to be a personal attack against another DU-er or a violation of any other DU rule will be reported to the moderators.
8 - If you object to these guidelines, do everyone else a favor and go to another thread.

1. Ky. Congressman's Brother Hurt in Shooting
"LEXINGTON, Ky. - The brother of Rep. Ben Chandler was recovering from a bullet wound at a Kentucky hospital Wednesday, a day after he was shot by an unidentified gunman.
Matthew Chandler was stopped with car trouble on a street in Lexington when a man stuck a gun through an open window Tuesday and shot him in the side, police said.
He was listed in fair condition at the University of Kentucky's Albert B. Chandler Medical Center, which is named for his grandfather, a former governor.
Police are investigating the shooting but declined to disclose details.
Ben Chandler, the former state attorney general who last month won a special election to represent central Kentucky in Congress, spoke to his brother by phone Wednesday. "

3. Jury Finds Teen Guilty In Punchbowl Shooting (HI)
"A jury Wednesday found an 18-year-old man guilty of attempted murder in the shooting of a man in his Punchbowl home last summer.
Miti Maugaotega testified that he was in the process of looking for valuables when Eric Kawamoto, 44, arrived home. He said he ordered Kawamoto downstairs, but Kawamoto didn't comply, and instead confronted Maogaotega.
The teenager testified that he didn't plan to shoot anyone that day, and had never fired the gun before.
Kawamoto survived the shooting and testified against Maugaotega in court. "

"Anthony Lane, 38, is charged with second-degree assault and three counts of conspiracy to commit first-degree murder. Lane surrendered to police late Tuesday at the Western District station in Odenton.
He was being held without bond yesterday at the Anne Arundel County Detention Center near Annapolis.
According to police, Lane and Nathaniel Campbell, 22, crashed a party at the house of Lane's ex-girlfriend Saturday and started a fight when they were asked to leave.
Police said that Lane ordered Campbell to get a gun, and that Campbell then opened fire on a crowd of people outside the house in the 2000 block of Lake Grove Lane. "

9. criminal misuse in gun control paradise
it is illegal to possess a handgun, much less a loaded one, in Maryland unless you are:

1) on property you own or where you reside,
2) at your owned place of business,
3) at a legal shooting range,
4) or transporting it, unloaded, between those places.

5. Slain man a victim of crimes repeatedly (NC)
"Walter Yanez-Cruz had been the target of at least three Charlotte crimes since 2001.
He was a victim for the last time early Tuesday.
Yanez-Cruz, 22, was found shot in the chest outside Break Room Billiards at 6427 E. Independence Blvd. Paramedics took him to Carolinas Medical Center about 12:40 a.m. where he later died.
Herron has been charged or cited more than 50 times since 1996, accused of violations and offenses ranging from driving with a revoked license to robbery with a dangerous weapon, Mecklenburg records show. While Herron has been a frequent suspect, police records show Yanez-Cruz was a repeated victim.
Yanez-Cruz and some friends were in his apartment on Monroe Road Aug. 29, 2001, when a man came to the door, according to a police report. There was a struggle and Yanez-Cruz was shot. Two men were charged in that shooting."

6. Standoff Ends In Deadly Shootout (OH)
"A standoff on Cleveland's east side came to an end in a deadly shootout overnight, NewsChannel5 reported.
After 12 hours, police went into the house on Lincoln Avenue and East 151st Street and found Eren Beyah, 27, on the second floor with a weapon. Officers said he pointed a gun at them and police fired, killing Beyah.
Police said the shooting started at about 2:30 p.m. when Beyah began firing at construction workers near his home.
When police arrived, Beyah reportedly fired several shots at police, who returned fire. He then barricaded himself inside the home on Lincoln Avenue and East 151st Street. "

Police were called to the parking lot outside a La Quinta Inn off J. Turner Butler Boulevard near Interstate 95, finding the body of a man inside a car.

8. Guilty Verdict Handed Down To Pedestrian Who Killed Driver (NM)
"A jury has found an Albuquerque man guilty of second-degree murder, aggravated assault and unlawfully carrying a firearm.
The verdict came almost a year after Thomas Newsome Jr., 57, fatally shot a motorist near the University of New Mexico on April 8, 2003. The man authorities said Newsome gunned down -- Eric Hunter, 39 -- was shot four times with a .22-caliber pistol.
At the time, the attack was described as a case of pedestrian rage. Newsome, who was homeless at the time, testified he was walking in a crosswalk at the corner of Yale and Central when he was almost hit by a van driven by Hunter. Newsome followed Hunter into a store where he kicked him and then shot him. "

"A woman was shot when she found a man trying to steal her car in a Rice Village parking lot, officials told News2Houston.
Police said the woman was putting packages in the back seat of her car in the parking garage in the 2400 block of University at Morningside around 2 p.m. Wednesday when she saw a man in the driver's seat trying to steal the vehicle.
"The assailant turned around and told her to stay in the car. She didn't say anything. She just proceeded to get out of the car and get out of there. At that point in time, he opened fire on her," said Dee Anna Chappell, who helped the victim. "

11. Tulsa homeowner shoots intruder (OK)
A homeowner defends his home with extreme force. It happened at a home located on East 7th Place around 1 AM Thursday.

Tulsa Police were checking on a call of gunfire in the neighborhood when they were called to the home. It seems the homeowner took action when an unknown man under the influence of alcohol or drugs threatened his family.

Tulsa Police Captain GB Poindexter: "He had a gun in his hand, pointed at the resident who opened the door. The resident's father came out and shot the bad guy one time in the right side."

The man was taken to a local hospital, his injuries are not life threatening. No one in the home was arrested....


The District Attorney has not yet said what charges may be filed against whom.

"The victim, identified as Marc Callender of West Philadelphia, was fatally wounded shortly after 8:30 p.m. while on the 200 block of South Allison Street. He was taken to the Hospital of the University of Pennsylvania, where he was pronounced dead 20 minutes later. Police did not know the motive for the slaying and had no one in custody last night."

"MIAMI - A father was charged with negligence in the death of his 3-year-old son, who shot himself while playing with a gun he found in the man's car.
Prosecutors said Travis Jenkins Sr., 26, improperly stored the gun, which his son found near the driver's side floorboard of the car Jan. 19. Jenkins was outside the car talking to a friend when the boy picked up the gun and it fired.
Travis Jenkins Jr., who was wounded in the forehead, died three days later. "

"New Orleans police are asking for the public's help in locating and identifying two suspects wanted in connection with an armed robbery at a local drive-up ATM.
The robbery occurred Monday just before 7:30 p.m. at the Hibernia branch at 3800 Gen de Gaulle Drive, in Algiers.
According to investigators, a 29-year-old New Orleans man drove to the ATM and was approached by two men who produced handguns and forced him to withdraw cash. The man then drove away and called police. "

But as it came to an end and Zachary Webb and Calvin Ector got out of friend Gregory Johnson's car on a Bellwood street after saying goodbye Monday, the routine was shattered by a spray of bullets from a high-powered rifle, Zachary said Wednesday from his home.
First he ran. And when he went back after police had arrived he found his childhood friend, Calvin Ector, lying dead on his stomach. His eyes were closed and he looked as if he were sleeping.
Bellwood police are still checking some 20 shell casings found at the scene to determine if it was in fact an AK-47 or another kind of high-powered weapon. Casings from a 9mm semiautomatic pistol also were recovered."

"WASHINGTON -- Senate Republicans scuttled an election-year bill to immunize the gun industry from lawsuits after Democrats amended it Tuesday to extend an assault-weapons ban and require background checks on buyers at gun shows.
    The Senate killed the measure 90-8 after the National Rifle Association began pressuring senators to vote against the bill because Democrats had inserted the two gun-control provisions.
    During earlier debate, Utah Sen. Orrin Hatch said if gun-control advocates tried to retain the two gun-control measures he would counterstrike by offering as an amendment his bill to strip the District of Columbia of its 1976 law against handgun ownership.
The threatened repeal of the Washington gun law never materialized as Democrats won close votes on their amendments to change the Republican legislation, a strategy aimed at pressuring the GOP-dominated House to accept the restrictions to gain passage of the gun maker immunity bill.
    Underlining the importance of the day to Democrats, presidential contenders John Kerry of Massachusetts and John Edwards of North Carolina broke away from the campaign trail to cast their first Senate votes of the year, joining the 52-47 majority on the assault weapons ban and the 53-46 majority on the gun show bill. A dozen Republican senators voted for one or both of the provisions. "

Don't know why they're bitching...the Medicare thief had the nutcase brigade check their PDAs and obey Big Brother Wayne's voting instructions to the letter.

Daschle has been refusing to let the Senate send legislation to conference committees with the House to protest being excluded from conference committees last year. "

27. Man In Wheelchair Shot At Home (FL)
"A wheelchair-bound man was shot early Thursday at a hotel near St. Johns Bluff Road and Beach Boulevard.
Robert Harvey, 46, was shot several times at the In-Town Suites where he lives. A nearby neighbor called 911 at about 2:15 a.m.
"He just said he'd been shot," explained the neighbor. "He thought he had his door closed all the way -- he didn't. Someone busted through the door, came in looking for money and shot him. He said the gun accidentally went off. They went to hit him with the gun and the gun shot him."
Neighbors said the man was in a wheelchair because he'd been shot before. "

"Three men who robbed a Boca Raton steakhouse were behind bars Wednesday after leading authorities on a chase through several south county cities.
Witnesses said the three men, armed with handguns and rifles, stormed into Chuck's Steakhouse.

Grand jury says simple steps could have saved man killed by police pepper spray

The grand jury that investigated the case of a man who died after being pepper sprayed by police and examined by paramedics issued a report Wednesday spelling out three simple ways the man's life might have been saved.

First, Fort Lauderdale police officers should have told the paramedics they pepper sprayed Raymond Sterling Jr., 21, after he ran from a traffic stop and struggled with them, rather than saying Sterling was "exhausted."


Second, the paramedics who arrived at the city jail should have used a basic tool they carry to measure the oxygen saturation in Sterling's blood. The paramedics spent six minutes with the dying man, taking his pulse and respiration and waving ammonia inhalant under his nose before leaving.

46. It is the end of the day...
it isn't meant to be disruptive, doesn't have anything to with RKBA, but makes you say hmmmmmmmm. Just thought some might like seeing it. It is discussed over on SigForum.
