State lawmakers: Cities can’t ban guns in parks, town halls (GOP/NRA Nanny State)

Do handguns belong in South Florida’s parks and recreation centers and city halls?

They do according to the Florida Legislature.

Under a new law that takes effect Oct. 1, all of the state’s cities and counties must repeal local rules limiting gun ownership. Although the state has claimed sole right to regulate firearms since 1987, this year’s new law adds fines for local officials who fail to comply, and gives gun owners a right to sue for damages if they believe their rights have been violated.

Though the initial bill suggested a fine of $5 million, the final legislation lowered the amount to $5,000.

That whole "local control and fuck the actual law" jazz is the basis of the whole "states' rights" thing. A city is no more allowed to contradict state law than a state is the US constitution.

If the state had backed the city ordinances, instead of creating the 'Streets of Laredo' scenario that will probably occur.

This was nothing more then raw meat being thrown to the beasts in the arena...a political ploy to make people forget about the dictator and his puppet legislators...who will be re-elected by those whose cognitive functions automatically shut down when guns and God are mentioned...

Florida makes the gun laws, local communities can't.

Nobody ever considered that some petty tyrants might decide to ignore the rules and make their own local laws, so there were no penalties for officials who did.

Now there are.

Now I can drive around Florida with my concealed handgun and my carry license and I don't have to carry a printout of all the stupid gun regulations in every little town that I visit. I do have to follow the State of Florida rules on where I can carry and where I can't.

That sounds reasonable and fair to me.

Gun ownership is growing fastest among women and minorities. The removal of the classist and racist gun laws are making gun ownership more accessible to those who need the self defense they provide.

While there are certainly economic and other injustices in this country, tying it to firearm ownership is not appropriate

16. I had a CCW instructor, a retired police detective,
that said to a student who was asking about carrying in a bar or club. "Why would you want to go anywhere that was so dangerous that you thought you needed to carry a gun". He was a very smart and experienced man.

45. I don't worship guns but I do carry them ...
I agree that it's wise to avoid going to dangerous places, but that's just good advise for everybody.

In Florida, I can't legally carry in a bar. I can and do carry in the non bar portion of establishments such as restaurants or bowling alleys.

If it was legal, I would carry in a bar if I was not drinking (perhaps a designated driver). I would never carry and drink.

"A year after the change, The Miami Herald reported that the number of people in Florida with permits for concealed weapons tripled.

Lawmakers who support the statewide rules argue the same thinking as that behind the state’s uniform traffic laws. Gun owners, like drivers, travel and need uniform rules no matter where they are in the state.

“We have hundreds of government entities in Florida. If each one developed its own nuanced style of regulating gun laws, just someone crossing county lines could become a criminal,” said Rep. Matt Gaetz, the Fort Walton Beach Republican who sponsored the bill.

When asked why it why it was OK for state leaders to allow cities to beef up their local laws on a host of other issues, such as where sex offenders can live, but not gun control, the NRA’s Hammer replied, “sex offenders are not protected by the Constitution.”"

55. The Texas Rifle Association and the Texas Civil Liberties Union both supported...
changes in Texas law which made more uniform laws allowing the transport of weapon across county lines. 'Seems a few years back goose hunters returning to Houston were stopped and cited for illegal transport of guns (shotguns were unloaded and plainly visible in the backseat), and the Harris County Sheriff came down on them hard.

He doesn't anymore.

39. Note that the CCW law passed in 1987 had state preemption of local gun laws ...
the problem was that no penalties were set up to fine local officials who decided to create their own local firearm laws. No one ever expected this to happen. Now local officials can be fined if they attempt to set up their own regulations for concealed carry.

Gulf Breeze examines gun-related ordinances

The Gulf Breeze City Council this week OK’d changes to its code of ordinances that are meant to ensure the city has no gun regulation laws on its books that conflict with state gun laws.

Anyone who enacts or enforces any law that could be construed as regulating firearms could be personally held legally responsible and face law suits and stiff civil fines.emphasis added

The state sets the rules and they are supposed to be state wide. I should have no reason to know the local rules in every little town and burg as I travel if I have a state issued Concealed Weapons Permit. The state sets the rules on where I can and where I can't carry a firearm.

That's the way it should have been and now, finally, that's the way it is!

The new law will irritate the hell out of those who love bans and restrictions on everything from McDonald's french fries to firearms. That alone makes me smile.
