GUNS IN THE NEWS--March 16, 2004
As CO Liberal sez:
Please try to adhere to the following voluntary guidelines, in order that we can have an orderly discussion of gun-related news topics:
1 - Feel free to add any CURRENT stories to this thread by replying to this message. In order to be considered current, stories should have been originally posted on the Internet within the previous 24 hours, or provide follow-up to a story that was previously posted on the J/PS board. On Mondays (since many people do not log in to DU over the weekend), stories can be posted from Saturday, Sunday, or Monday.
2 - Both pro-gun and anti-gun stories, editorials, and press releases are welcome in this thread, as long as they're current. Please do not post links to items from a few years back that support your position.
3 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) or intentionally pro-gun or pro-control sites (such as the NRA or the Brady Campaign) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive.
4 - Do not change story titles. In other words, if the Oskosh Gazette's web site runs a story titled "Two Killed in Holdup", the title of your message should read "Two Killed in Holdup". Don't change it to "Gun Owner Kills Two People", or anything else that changes the meaning of the story.
5 - If it's not clear from the title where the story occurred, add the city, state, or country in parentheses after the title.
6 - The person adding a news story to the "GITN" thread is allowed (and encouraged) to comment on that story, indicating their position on the topic being discussed. These comments can appear either at the beginning or end of the post; if possible, place comments in a different typeface so readers can separate the comments from the story. Others who wish to comment on a posted story can do so by replying to that story; this allows other readers to follow the comments by scrolling through the subthread.
7 - Please direct your comments to the story, rather than attacking the person posting the story or any person responding to the story. In accordance with DU rules, any message that appears to be a personal attack against another DU-er or a violation of any other DU rule will be reported to the moderators.

1. Ohio Shooting Suspect Unknown to Neighbors
"COLUMBUS, Ohio - Most people living in a neighborhood of tidy vinyl-sided homes didn't know much about the quiet man who moved into a house there with his mother about a year ago. Most didn't even know his name.
Then they saw his picture on television Monday night, as investigators looking into 24 highway shootings around Columbus said they were seeking Charles A. McCoy Jr., who was considered armed and dangerous.
The Franklin County Sheriff's Office issued an arrest warrant for McCoy, 28, in a Dec. 15 shooting that left a bullet in the bathtub of a south Columbus home — a bullet matched by lab tests with eight other shootings. The other highway shootings had been linked by location and circumstance."

The first mention I have heard of the caliber this creep was shooting.

And the answer is... 9mm. This nutbar has been shooting at people from overpasses with a pistol, that's why they haven't been able to spot him.

applaud what he did? Nope. What he was using has been in question since this whole thing started. The ANTI-RKBA crowd can breath an easy sigh of relief that this is likely not a "sniper" with an assault rifle.

Perhaps you should read your own rule #7 above.

but he would likely have done more harm lobbing bricks off the overpass.

I must be far gone to actually worry about what they capabilities of this joker is, rather than wring my hands in fear day and night. I expect most hand-wringers to believe that any gun is a death ray, capable of laying waste to entire municipalities, especially when spray fired from the hip.

"COLUMBUS, Ohio - The man wanted by police in a deadly string of highway sniper attacks has a history of mental illness and is believed to have a semiautomatic pistol and ammunition, authorities said Tuesday.
Charles A. McCoy Jr., 28, lived with his mother within miles of where the gunman's bullets killed a passenger, shattered windshields, dented school buses and drilled into homes and a school.
"McCoy has had mental health issues in the past and is currently not on medication," the Franklin County Sheriff's Office said in a bulletin released to police departments across the country. "He is believed to have suicidal or homicidal tendencies." "

Neither the state of Ohio nor the federal government bar a person with a "history of mental health issues", or even a specific diagnosis like schizophrenia, from buying or owning a firearm.

Before you soil yourselves gushing about the misnamed gun-show loophole I suggest you wait until all the facts are in. It seems likely to me that, based on what we know now, the suspect could have passed the NICS check used by Ohio gun dealers and would not have been breaking any laws by buying or owning a gun.

There are other matters that may be relevant here, like how well his caretakers monitored his behavior or why he is not on any medication. What kind of mental health care was available to this individual? Did his family make use of all available resources? Was his case handled properly by the health care system?

One thing is for sure if the allegations are true - He fell through some big cracks somewhere.

Personally I think no "reasonable" gun control could have prevented this individual from doing what he is alleged to have done. I'd concentrate on mental health care.

"A man California Highway Patrol investigators said was the "prime suspect" in a spate of Interstate 580 freeway shootings was returned to San Joaquin County on Monday afternoon, an Alameda County official said.
Two days after Alameda County prosecutors said there was not enough evidence to press charges, Christopher Charles Gafford, 27, of Stockton was released from Santa Rita Jail in Dublin and into the custody of San Joaquin authorities, said Lt. Jim Knudsen, a sheriff's office spokesman.
Gafford had not arrived at the San Joaquin County jail by late afternoon, said Deputy Nelida Stone, a sheriff's office spokeswoman. She added that officials normally do not discuss details of inmate transfers for security reasons.
Gafford faces a bail revocation hearing in San Joaquin County stemming from an unrelated November drug case. He previously had a March 29 court date in Stockton, but now likely will appear before then."

Vicente Guitierrez's name and picture have been released in connection with the recent rash of drive-by shootings and gang activity. On Monday, a man claiming to be Gutierrez called Action 7 News.
We played that tape for Sandoval County Sheriff John Paul Trujillo, who said it was absolutely Gutierrez.

"A 59-year-old Shady Side woman was found guilty yesterday of first-degree murder for using a rifle to beat and shoot her husband to death over her mounting credit card debt.
It took an Anne Arundel County jury two hours to convict Terry Harriet Pierce Eslin of the most serious charge against her - one that could carry a possible life sentence without the possibility of parole. A sentencing hearing has not been scheduled.
Eslin and her lawyer have maintained that she suffered from battered wife syndrome, was temporarily insane during the attack and therefore is not criminally responsible for killing her fourth husband, Richard P. Eslin, 66, last year.
Prosecutors contended that she planned the brutal attack when her husband found out about some of her $48,000 credit-card debt. Richard Eslin had asked her to move out, and Terry Eslin testified Thursday that she was afraid of being homeless."

Her nephew, Larry Harper, 56, died at his home on Mississippi 468 about 9 p.m. Saturday after he was shot at least once in the chest, relatives and police said.
Harper's nephew, Antonio Stapleton, 24, was in fair condition Monday at University of Mississippi Medical Center recovering from a shotgun blast to one of his legs.
Stapleton fired a .38-caliber pistol at least four times, Slade said. Larry Harper shot his nephew at least once with a shotgun, which spread pellets from Stapleton's knee to his groin, Slade said."

The woman, a young mother and newly married, had been beaten countless times before and during her short marriage, sometimes with a belt, sometimes with fists, sometimes with her husband's open hand.

Her husband of less than two years had threatened to kill her family and showed her that he had the means to do it: a gun hidden in his boot.

So when King County prosecutors charged the man with several domestic violence crimes, including assault, in October, they asked for bail of $40,000. They also asked that he be ordered to surrender his gun.

City leaders also forbid concealed weapons in public buildings as application process starts.

On the first day that Greene County residents could begin applying for conceal-carry gun permits, city and county leaders banned such weapons from their buildings.

The county order, passed unanimously by the Greene County Commission on Monday morning, adds all buildings owned, leased or operated by the county to the long list of places where concealed weapons are not allowed.

The Springfield City Council unanimously passed a similar measure Monday night, barring concealed weapons from city buildings.

State statute already prohibits concealed weapons in courthouses, jails, schools and government meeting places. The statutes allows counties and cities to pass local laws regarding concealed weapons in government buildings.

WASHINGTON (AP) —
Commercial pilots say only a few of their colleagues are signing up to carry guns in the cockpit because the Bush administration has made it harder than necessary to participate.
The Transportation Security Administration initially opposed the program, then reluctantly endorsed it when it was clear Congress was behind it.

The Airline Pilots Security Alliance, a group formed by pilots to lobby for guns in the cockpit, says the TSA's stance has led the agency to impose unnecessary standards, chief among them a 14-page psychological evaluation.

Dean Roberts, a member of the alliance, is a former special agent with the Drug Enforcement Agency. He questions the need for the test, noting psychological and physical ability evaluations with Federal Aviation Administration doctors are performed every six months for captains and once a year for first officers.

"Niles is a neat, clean Ohio city located about 100 kilometres southeast of Cleveland. Aside from playing host to one of the state's biggest gun shows, Niles is also the birthplace of William McKinley, the 25th President of the United States. It just happens McKinley was shot to death by a deranged assassin in 1901 while touring the Pan-American Exposition in Buffalo.
This show, held at the Eastwood Expo Center near the intersection of several busy interstate highways, is typical of dozens of gun shows held across Ohio each year.
It featured table after table of guns, knives, ammunition, crossbows, helmets, gas masks and military camouflage outfits. One vendor was even hawking Nazi-themed t-shirts. Among the handguns on sale were everything from a small pearl handled "Ladies Gun" to a hefty .357 Magnum.
Shows such as these are the result of some of the loosest gun laws of any state in the Union. Ohio, along with Florida, boasts a law that allows individuals to sell firearms with no questions asked."

ALEXANDRIA, Va. --
Three licensed gun dealers were arrested and 25 guns were confiscated Monday in part of an investigation into gun trafficking in northern Virginia.

The three dealers are accused of selling guns to known felons. Investigators said they managed to get around the system by selling the guns to middlemen called straw purchasers, who filled out all of the paperwork.

Investigators said the three knew the guns were on their way to known felons who would otherwise not qualify for a gun purchase.

"All the efforts that we have to identify felons who are trying to find firearms are frustrating if straw purchasers can go in and make those purchases for them," United States Attorney Paul J. McNulty said.

"Greensboro, North Carolina-AP -- Police say an off-duty police officer's concealed gun went off during the Atlantic Coast Conference quarterfinal game between Maryland and Wake Forest on Friday night.
The gun accidentally discharged about midway through the second half, slightly injuring the officer in the buttocks. Police say no other injuries were reported."

27. Delray man, 19, charged in shooting of neighbor and his girlfriend (FL)
"DELRAY BEACH · A 19-year-old man feared by his father was arrested Monday morning, accused of gunning down one of his neighbors and his neighbor's girlfriend last week.
Tineson Bernadel of Delray Beach was charged in the death of Ricky Searcy, 39, and the shooting of Jarvis Peterson, 33. Peterson remains in intensive care in Delray Medical Center and is expected to recover.
Bleeding from gunshot wounds to her chest and buttocks, Peterson told Detective Gene Sapino just before she was taken away by ambulance that the man who shot her was the "Haitian male" who lives next door to her former boyfriend, Sapino said.
"I was concerned about her dying," Sapino said.
Peterson and Searcy were ambushed as they walked to Searcy's apartment about 9 p.m. Wednesday. Bernadel was waiting in an abandoned apartment across from Searcy's, fired his gun several times and then fled to his nearby home, Sapino said."

28. 2 women injured during shooting (FL)
"An early-morning shooting in their Holton Street home left two women hospitalized Monday, Tallahassee police said.
Beverly Hayes was in serious condition and Rose Bryant was in fair condition Monday night at Tallahassee Memorial Hospital, a nursing supervisor said. Their ages were unavailable.
Sgt. J.B. Johnson of the Tallahassee Police Department's homicide-assault unit said investigators are treating the incident as an attempted home-invasion robbery.
They also are looking into whether there's any connection to Sunday's shooting of a Top Flite nightclub patron.
Antonio J. Steele, 31, was shot twice in the neck outside his car at Okaloosa and Main streets. Police say it was a possible robbery after he left the club early Sunday."

29. Sturm Ruger: NJ Lawsuit Dismissed With Prejudice
Another one bites the dust. This might be a good time to pick up some RGR stock.

SOUTHPORT, Conn. (Dow Jones)--Sturm, Ruger & Co. (NYSE:RGR - News) said a trial court dismissed with prejudice a lawsuit filed against the company and other gun makers by the city of Newark, N.J.

In a press release Monday, Sturm, Ruger said it dismissed the case because the city failed to meet the requirements of a prior court order. The City of Newark needed to fulfill those requirements in order to apply for a reinstatement of the complaint prior to the March 1 deadline.

Because the case was dismissed with prejudice, Newark won't be allowed to file the lawsuit again....

"Interstate Highway 80 is now open in both directions in Solano County following the surrender this morning of a man with a rifle in a van on the shoulder of westbound I-80, the California Highway Patrol reports.
The 8:15 a.m. incident closed both directions of the highway and traffic backed up for miles. The man surrendered to the Solano County Sheriff's Department around 10 a.m. "

"LOS ANGELES (AP) - Police arrested a 16-year-old high school junior early Tuesday after he was overheard threatening to shoot two fellow students, authorities said.
A search turned up more than 50 rounds of live ammunition and two BB guns in the boy's home, said Officer Adriana Sanchez, a police spokeswoman.
No firearms were found, but investigators learned that the boy was trying to get a gun and expected to have it in several days, she said."

33. Slain pharmacist's estranged wife pleads guilty to gun charge (PA)
"The estranged wife of slain pharmacist Michael Jason Kerkowski pleaded not guilty Monday in U.S. District Court to a federal weapons charge.
Kimberly Kerkowski, 39, of 1204 Oak Drive, Shavertown, entered the plea during a brief appearance before U.S. Magistrate Judge Thomas Blewitt.
Judge Blewitt released her on her own recognizance.
The bodies of Mr. Kerkowski and his girlfriend, Tammy Lynn Fassett, were found buried June 5 outside accused double murderer Hugo M. Selenski's home on Mount Olivet Road in Kingston Township. They had been missing since May 2002.
Mrs. Kerkowski was indicted March 9 on a felony count of selling or disposing of a firearm -- a Ruger 9mm semiautomatic handgun -- to a known drug user or drug addict in the latter half of 2002. The recipient of the gun was not identified in court documents, some of which have been sealed."

36. Authorities Seek Armed Bank Robbers (OH)
"Police are searching for three men who they believe attempted to rob a bank in Bath Township Friday, reported NewsChannel5.
According to police, two men in ski masks entered the First Merit Bank on Route 18 Friday morning.
One of the men reportedly had a handgun, the other a shotgun or a rifle. The robbers fired several shots into the ceiling of the bank. They then forced a teller to fill a bag with money at gunpoint.
A third person was driving the getaway vehicle, a blue minivan stolen from a Speedway station about a half an hour before the robbery.
The van was found at a nearby condominium complex. Inside was the money, covered in red dye. The red dye-exploding device, along with a tear gas container, was placed in the moneybag by the teller. "

"ALEXANDRIA, Va. -- Two licensed gun dealers and a third man were arrested Monday in a sting operation in which they were charged with selling weapons to agents posing as convicted felons.
James E. Rice III, 41, of Manassas, Philip J. Bailey, 32, of Cross Junction and Charles S. Hyink, 47, of Falls Church were in custody as a result of separate investigations triggered by information from police informants.
"Rice, Bailey and Hyink sold firearms to individuals who represented themselves as felons or drug dealers," said U.S. Attorney Paul J. McNulty. Rice and Bailey are licensed gun dealers, while Hyink was employed by two licensed dealers, he said. "

42. Teen jailed in armed robbery (LA)
"A 15-year-old LaPlace boy accused of robbing a convenience store at gunpoint was arrested Saturday night after a short foot chase, the St. John the Baptist Parish Sheriff's Office said.
The teen was booked with armed robbery and is being held at the St. James Parish Juvenile Detention Center. He is expected to be arraigned Wednesday, authorities said.
Deputies soon spotted the teen running down Iberville Street and began chasing him with the help of a police dog, Klibert said. One of the deputies spotted the teen hiding behind a parked car in the 700 block of Iberville and tried to get him to surrender.
The two deputies found a black sweatshirt and a white bag containing $437 near the teen's hiding spot, Klibert said. They also found a black Glock 9 mm handgun in the teen's front, right pocket and a loaded ammunition clip for the gun in the teen's back pocket, Klibert said. The teen lives two houses away from where he was caught, Klibert said. Deputies found the red bandanna in the parking lot of a nearby church, and detectives have obtained a security video from the store to see if the robbery was caught on tape, police said. "

"Police said today they were developing information that could lead to suspects responsible for the first triple-homicide in Roswell's history.
Roswell police Sgt. James McGee said investigators might be able to provide a composite drawing of at least one suspect involved in the Monday shootings, but declined to say who had provided the description.
McGee did say investigators had not yet interviewed the lone survivor of the attack, who remains hospitalized.
Police were also withholding identification of the victims. Police were finding it tough to track down relatives and also have additional investigative leads they would like to explore before releasing names, McGee said Tuesday."

"Gwinnett County police were looking Tuesday for a Duluth-area man suspected in the shooting death of his wife.
Officers responding to The Springs apartments in the 4100 block of Satellite Boulevard about 1:30 a.m. Tuesday found the body of the Hispanic female, who was in her early 30s, according to Gwinnett police Cpl. Dan Huggins. The victim, whose name was being withheld, had been shot in the head.
Several children inside the apartment told officers that their father had shot their mother, then fled, Huggins said."

SOUTH VIENNA | A Mechanicsburg man who rode away on a bicycle after being shot in the neck Tuesday with a .45-caliber revolver during a domestic argument with his wife and her brother was later arrested on violence-related charges.

Eric Champlin, 22, of 8546 Brigner Road was released from Community Hospital after being treated for the gunshot wound.

He was shot at 5485 Lundy Lane and arrested at 5295 Lundy Lane, where he had fled, deputies said.

He was charged with felonious assault, felony domestic violence and aggravated burglary. He is to be arraigned today in Municipal Court.
