Barbara Sheehan gets 5 Years for Gun Charge

I'm not sure if we came to a consensus http://mikeb302000.blogspot.com/2011/10/woman-exonerated-in-ny-shooting.html">last time we talked about this one, so just in case I didn't make myself clear that time, here's my take on it. She's going to jail for the wrong reason. The District Attorney said it right.

"Barbara was not the victim in this case," Assistant District Attorney Debra Pomodore said. "Raymond, her husband, was the victim."


I'm all for women's rights. I'm the one who keeps linking to my http://mikeb302000.blogspot.com/2009/07/guns-and-women.html">"guns are bad news for women" post. But in this case, what she did is no different than all the other cases we read about in which someone snaps and uses a gun.

Temporary insanity might have worked, but not the battered wife defense. That's my take on it. What do you think?

1. I would like more detail
like how they came to this conclusion. I take it the revolver was hers and the Glock (I think is an NYPD issue) was the husband's?
Jurors, nine women and three men, found the wife guilty of a weapons charge for using the Glock. She was found not guilty of a second weapon charge for using the revolver.

Whichever the murder defense she used, it worked. Your take does not really matter although I would like to read your reasoning behind your take. Some places don't allow the temporary insanity defense. Wyoming does not, as Mathew Sheppard's killers found out IIRC.

8. Yup - I agree she went to jail for the wrong reasons..
never should have gone for a gun charge.

It should be lawful to use firearms, preferably your own, for justified self-defense anywhere.
