Woman fires gun to ward off man trying to steal her car
“He was hitting me from behind, trying to force me into my vehicle,” Bennett said.

Bennett struck the man with her elbow, then was wrestled down across the front seat of the SUV. While lying on her back, with her assailant atop her, Bennett arched her spine, opened the SUV console with her right hand and pulled out her firearm.

“I said, ‘I got a gun. Don’t make me use it,’ ” she recalled. “I think my heart was going 90 mph.”

While the man tried holding her arm, she fired a shot out of the open passenger door. The assailant had enough. He ran off. Bennett was not injured.

She was a rude toter, afraid to go out in society without a gun or two strapped to her SUV, and making all of society more dangerous and fearful as a result. She should have just gone along with him for the ride instead of making waves. She might have frightened the poor fellow.

2. Where did the shot go she fired out of the car door?
If she would have hit a passerby with that shot would she have been held liable?

4. She probably would be liable in a civil court.
I doubt that was her first concern at the moment.

Personally, I'd hope my wife would just shoot the b*stard and not take the time for warning shots or telling him, "I have a gun."

5. "liable" for injuries/damage in self-defense? I doubt it...
She was under attack -- persistently and aggressively under attack -- and she not only warned the HyperPunk that she had a gun, but fired only when he CONTINUED the attack. I doubt even a civil jury would have found against her as she was defending herself from a hard, mean attack which threatened her life, and fled ONLY after she fired.

If I was on any contemplated civil jury, I would most assuredly not find against her.

7. I think the question refers to what if that bullet hit an innocent bystander,
someone walking down the street half a block away.

She'd probably be held liable for damages in a civil court if she maimed or killed someone, even accidentally while she was trying to defend herself from the perp.
