IDF order will enable mass deportation from West Bank

A new military order aimed at preventing infiltration will come into force this week, enabling the deportation of tens of thousands of Palestinians from the West Bank, or their indictment on charges carrying prison terms of up to seven years.

When the order comes into effect, tens of thousands of Palestinians will automatically become criminal offenders liable to be severely punished.

Given the security authorities' actions over the past decade, the first Palestinians likely to be targeted under the new rules will be those whose ID cards bear home addresses in the Gaza Strip - people born in Gaza and their West Bank-born children - or those born in the West Bank or abroad who for various reasons lost their residency status. Also likely to be targeted are foreign-born spouses of Palestinians.

Until now, Israeli civil courts have occasionally prevented the expulsion of these three groups from the West Bank. The new order, however, puts them under the sole jurisdiction of Israeli military courts.

The new order defines anyone who enters the West Bank illegally as an infiltrator, as well as "a person who is present in the area and does not lawfully hold a permit." The order takes the original 1969 definition of infiltrator to the extreme, as the term originally applied only to those illegally staying in Israel after having passed through countries then classified as enemy states - Jordan, Egypt, Lebanon and Syria...

to be the WB... and with the spreading checkpoint system (even in 1997) it was simply impossible to live there.

On Tuesday, April 13 2010, the Order regarding Prevention of Infiltration (Amendment No. 2) and the Order regarding Security Provisions (Amendment No. 112) are to enter into effect. The orders, signed by the previous GOC Central Command, Gadi Shamni but not revealed, are worded so broadly such as theoretically allowing the military to empty the West Bank of almost all its Palestinian inhabitants. Despite the severe ramifications of the orders, the authorities did not publicize their existence among the Palestinian population as required, which raises grave concerns that they intended to pass them secretly without public debate or judicial review....

Every Palestinian from Gaza, who is outside of Gaza without a tisreeh lives in fear of this bullshit. They tried to torment Gazan students at the University with this law in the mid-80s and the Gazans refused to register.

Any solider at any checkpoint can do anything he damn pleases when people carrying a Gazan huwiyye are found outside gaza.

I LIVED THIS NIGHTMARE IN THE MID-NINETIES. and it was a NIGHTMARE in the midst of Oslo's halcyon days. I can only imagine what it's like now.

I'm not around as much so I don't always have the time to respond when I comment.

As far as this topic goes I haven't been following it so much so I don't really have the knowledge to comment intelligently on Israel's motivation. However I use common sense whenever I look at accusations like the ones leveled at Israel in the OP and it seems to me somewhat unbelievable that this order is preceding a mass expulsion of tens of thousands of Palestinians.

I looked around a bit and happened to find another article about it in the Post.

After creating an international scandal, on Wednesday Haaretz acknowledged that the supposedly new order has been in place since 1969. What changed in January is that the IDF decided to expand the rights of illegal aliens in Judea and Samaria to pre-deportation hearings.

This was not a change for the worse in the status of illegal residents. It was a change for the better.

And still, due to Haaretz’s misreporting, Israeli diplomats are being called into the chanceries of the world and raked over the coals for the country’s alleged plot to conduct a mass expulsion of Palestinians.

So we can discuss the validity of the order in the first place, which I think is a topic worth discussing. But when it comes to the hyperbole implied by this article, that Israel recently gave itself a new power to begin a policy of ethnic cleansing, we shouldn't hesitate to critique facts contributing to undeserved hysteria. Criticizing Israel for this order is one thing... on its face it seems to be an outdated policy that doesn't serve the interests of anyone anymore. But attacking Israel because it is supposedly about to begin doing something that it obviously has no intention of actually doing is quite another. Obfuscating the facts of any facet of this conflict with dramatic intent should be decried, regardless of which side does it or to what end.
