And his argument about Congress passing an unconstitutional law and having to be overruled by the Prez has NOTHING to do with this case.It is the Gonzales memo which could be considered unconstitutional How does the Pres, authorizing an unconstitutional act through his surrogate have anything to do with this?

1. The Repubs are running short of people to speak in favor of Gonzales

There just aren't a lot of them who will stand up and speak in his favor, so Orrin Hatch has to carry the ball for him. He's been up every day, speaking for hours - he must have used at least half of the entire Repubs alotted time for himself.

They'll vote for him, no doubt about it, but they're having trouble getting their folks to speak in his favor.

At least that's my take on the matter.

2. When Orrin yaps on and on his fellow Senators refer to

it as "Orrinating". They send notes asking him to stop Orrinating. Washington folks have been using the term for many, many years- every since Hatch arrived.
