GOP introduces bill to suspend ALL laws

On January 26, 2005, Rep. Sensenbrenner introduced the REAL ID Act of 2005. In the name of homeland security, it includes a number of items changing immigration laws, use of drivers' licenses, etc.

But -- most overlooked -- is Section 102 of this bill. It would empower the Secretary of Homeland Security to suspend any and all laws in order to ensure the "expeditious" construction of a set of barriers and roads south of San Diego, to keep illegal immigrants out. It also would prohibit ANY judicial review of the Secretary of Homeland Security's decision to suspend any law. ON EDIT: While the law the bill references mentions barriers and roads "near San Diego," it does not appear to be (technically speaking) limited to that area -- but to any barriers or roads "in the vicinity of the United States border." (See comments below).

The text of Section 102 is below:

SEC. 102. WAIVER OF LAWS NECESSARY FOR IMPROVEMENT OF BARRIERS AT BORDERS.
Section 102(c) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1103 note) is amended to read as follows:

`(c) Waiver-

`(1) IN GENERAL- Notwithstanding any other provision of law, the Secretary of Homeland Security shall have the authority to waive, and shall waive, all laws such Secretary, in such Secretary's sole discretion, determines necessary to ensure expeditious construction of the barriers and roads under this section.

`(2) NO JUDICIAL REVIEW- Notwithstanding any other provision of law (statutory or nonstatutory), no court shall have jurisdiction--

`(A) to hear any cause or claim arising from any action undertaken, or any decision made, by the Secretary of Homeland Security pursuant to paragraph (1); or

`(B) to order compensatory, declaratory, injunctive, equitable, or any other relief for damage alleged to arise from any such action or decision.'.

What does this mean? What laws might the Secretary of Homeland Security suspend?

The first obvious sets of laws that would come under attack would be environmental and labor laws. On the environmental side, think "Endangered Species Act." On the labor side, think "Davis-Bacon" prevailing wage laws and the right to organize and collectively bargain.

Also think "whistleblower laws." Homeland Security wouldn't want any pesky do-gooders blowing the whistle on corruption in contract awards.

But wait, would all of these suspensions only apply to the physical, on-location construction of the roads and barriers?

Nope! There's no such limitation in the law. You can follow this right to suspend the laws anywhere someone might be claiming legal rights and slowing down the process. The manufacturers of equipment and materials would certainly fall under this provision, for example. The government workers dealing with any aspect of this construction, in Washington or California or wherever would also fall under this provision. A city council objecting to something about the project could fall under this provision.

It's an incredible usurpation of the rule of law. A cabinet secretary is given the right to suspend any and all laws. And guess what? The courts are prohibited from reviewing his decision! Perfect! So the Secretary can abuse his "authority" all he wants. No review. No nothing. Welcome to the Second Term.

If we let this legislation get through, we're screwed and this country is going to be in chaos.

Better to see that it doesn't happen.

To echo the immortal words of Patrick Henry, "Give me liberty or Give me death." Yeah, I'm in it for the long haul and it if comes to an ass kicking on the current administration who isn't going to be ready to stand up and fight?

Still, if we all work together and get the word out, maybe we can save our way of life before it gets flushed down the toilet.

66. This reminds me of the Patriot II stuff stuck in an Omnibus bill.
Did those Patriot II provisions get passed? I think they did 'cause they were last minute stick-ins that essentially knew about until after the bill was voted upon.

Erecting barriers for immigration reasons isn't even the issue....

Giving the Secretary of Homeland Security the RIGHT to use such and action to SUSPEND ANY and ALL Laws without JUDICIAL review is what we need legislators to clamp down on, WHENEVER it comes up as a tagline to any resolution they review.

America is NOT a country that ALLOWS carte blanche authority. Period.

If the CIA has real intelligence that the whole Al Queda network is coming up from Mexico, let them build a wall. But the legislators and Judges need to have full disclosure of that information and should be empowered to still vote with their brains in tact, not their hands tied.

I would like to know who the hell inserted such an appalling provision.

Someone seeks to violate both our constitution and our "freedom". I wonder who put that fascist/totalitarian provision in there!!!! They should be strung up by their,...ummm,...ears!!! At minimum, they should be publicly exposed, shamed and scorned for such a traitorous violation of our laws, country and people!!!!

Unconstitutional on its face is right! This bill sounds to me like a bill of attainder, unconstitutional under Article I, Section 9, paragraph 3: "No Bill of Attainder or ex post facto Law shall be passed."

Definition of Bill of Attainder: A legislative act that singles out an individual or group for punishment without a trial.

Congress saying "No Judicial Review." Who's the arrogant asshole who wrote that?

Even the right-wing jurists in the Supreme Court would unzip and pee on that provision.

We have to shame every legislator, every senator, every judge and any American who does not stand against the loose provisions in this law giving the President the right to destroy the checks and balances we have come to rely on as Americans.

Start sending emails people. There is a link here to the resolution itself. I think people should go there and make a copy so it doesn't disappear and just show up somewhere else in other laws down the line. Our chimp is persistant, but he is up against Americans and if he thinks he's going to take our country without a fight via the backdoor of an immigration resolution, he's sadly mistaken.

,...provision was stuck in another piece of legislation.

Do you remember? I've wreaked my brain trying to remember the last time this happened and the Republicans were spinning like crazy finally blaiming some "aid" for sticking in where it didn't belong.

Nevermind,...I am thinking about the examination of tax records incident.

126. I cannot remember the original bill,
but what they were sneaking through was a provision to allow anyone who donates $$ to a political campaign to have their taxes become public documents, for any one to read. This, at least, was the jest of it as I recall.

Whenever I hear a right wing yahoo talk about enacting laws which deny judicial review of the law I wonder how in the hell that idiot ever got out of 9th grade civics class.

In Marbury v. Madison (1803) Chief Justice John Marshall asserted a Supreme Court ruling that the Supreme Court possessed the power of judicial review over laws of Congress.

Without that power, there is no value in a judiciary branch.

Very disconcerting stuff.

And also troubling is that it really isn't just the Rupukes, there are plenty of Dem's who go along.

The heart of this evil stems from corporate interest and a push by big money toward global corporate fascism - a.k.a "welcome to the new world order."

We're living in extreamly extraordinary, and exciting times. Exciting not in the good sense, but of course in the bad sense. We are actually witnessing the start of things that so many leaders of our past warned us about. Things that even our founding fathers warned us about.

It also troubles me that I have tried to bring some awareness to some people; but still many people out there (to include in my own family) are still oblivious to the world we live in and what direction we're going in.

I am 38 and I am confident that in my lifetime I will witness (and take part in for sure) major historic events such as uprisings on the scal of the 60's, and possibly an economic depression. There will also be a whole lotta misinformation disseminated from our state --I mean corporate-- news media.

To me, its no longer a question of IF, but rather how far will the rubberband stretch before it snaps.

I say that if anyone looks for a place to delare independence. Califorenia is a very good state for many different reasons. Actuall the whole West Cost. :)

Lived in Cali from 8 - 18 and there is a whole aspect of it being the farthest West you could go and still be in the country that makes me think people just wanted to be free to live their lives and passed it on to their kids over the generations.

We DO need to be VOCAL and get the information out at Democratic Meet Ups and such. We CAN make a difference. I just hope we have the time. Grass grows slower than destructive forces can demolish it sometimes.

This forms the best example of the worst part of our nation's history.

This is where the dismantling of all checks and balances in Congress come into play.

If you really read into this, the U.S. Congress could be prevented from passing a law to contradict this. The judicial system is completely left out.

Now will people finally see the Hitler/Stalin/Mussolini connection?

The ability of the government to at any time for any reason audit your taxes?

What on Earth did they need to put that little rider in there for?

Establishing that they can take away our Bill of Rights behind our backs - this is in direct violation of "Unlawful Search and Seizure". There is already a caveat to randomly audit and the repubs made sure no rich people got included in that. It's for intimidation purposes.

This Homeland Security add in is setting up martial law parameters.

And the Torture Memo? It doesn't exclude US.

The Bill of Rights: A Transcription

Note: The following text is a transcription of the first ten amendments to the Constitution in their original form. These amendments were ratified December 15, 1791, and form what is known as the "Bill of Rights."


Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.


Amendment II

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.


Amendment III

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.


Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.


Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.


Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.


Amendment VII

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.


Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.


Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.


Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

What is insane about this administration is they are systematically dismantling the checks and balances so that we are a Democracy in name only.

This is they type of law a dictator enacts to give them authorization for martial law. Just because the chimp says he was elected doesn't mean he isn't a dictator.

I don't want to get into the Hitler thing, but he's talking about building fences. In WWII we had Japanese detainee camps and we didn't hear about it for years and years.

GW2 isn't treating American's in the lower 75% as humans as it is. He is destroying all regulation that gives us clean water and air and keeps fecal matter out of our food supply.

He's encouraging people to be bigotted even while he parades around his token blacks or hispanics to show how it's really the people who aren't bigotted that are racist.

With the insanity of this administration's logic, no one can predict WHO will wind up behind the fences this time.

And remember - in order to not appear to be in favor of loose immigration standards ...ALWAYS discuss this in terms of LAWLESS PROVISIONS THAT EFFECTIVELY DISMANTLE THE CHECKS AND BALANCES INHIERENT IN THE CONSTITUTION being placed in a Resolution that has to do with immigration.

there is no such thing as a law that cannot be reviewed by the courts. That is not how our system works and I doubt that Congress can bypass that. Sensenbrenner is not a Republican, he is a fascist. Can't we start using that instead of an R after their name??

is what killed the line-item veto. This in essence, would be allowing the Secretary of Homeland Security - not even the President - to veto laws after the fact. Not only is it unconstitutional it is outrageous. They are giving Homeland Security dictatorial powers. And - oh yeah - Congress cannot tell the courts what they can or cannot review.

My rep may be a repub I can't remember, but when I wrote to him I tried to appeal to his integrity because I couldn't remember if he was DEM or repub.. he's a DEM, and in just in case I tried to word it that any one regardless of affiliation should not allow this to go unchallenged. That's their job. Know what I'm saying?

All of my conservative friends don't care much about any "Rights" when it comes to Homeland Security, but they ALL do care about "Property Rights".

I was very disappointed by the outcome of your inspirational and patriotic attempts to block the confirmation of Alberto Gonzales. I am also very aware of the 4 Democratic Senators who failed to understand the seriousness of confirming the author of torture policies that our president has PRIVATELY condoned and PUBLICLY denounced for the past two years!

It was with great regret that I had to witness two yay votes from my own Senators in Washington. I have emailed this information to them and several other White House politicians but I encourage you to disseminate this information liberally among your fellow politicians in Washington before Wednesdays rhetoric.

Dear Martin Olav Sabo,

I hope you are planning on blocking the legislation House Judiciary Chairman James Sensenbrenner (R-WI) intends to introduce on Wednesday. This bill on it's face is innocent enough, don't impede attempts to construct barriers to prevent illegal immigration.

However, in section 102 of the REAL ID Act of 2005 (H.R. 418) the GOP has slipped in another attempt to undermine the Constitution and our rights as citizens. It puts the Secretary of Homeland Security above the law with no judicial review possible.

I've been in Minnesota for many years and I don't think you would willingly dismantle the constitution, but I was very disappointed by the outcome of attempts to block the confirmation of Alberto Gonzales and so I'm not taking it for granted that you have seen the significance of section 102's implications.

There was so much spin on Gonzales that although I realize the Democrats alone couldn't have stopped him, the Senate's failure to understand the seriousness of confirming the author of torture policies that our president has PRIVATELY condoned and PUBLICLY denounced for the past two years shows how broken our Democratic process has become.

This new resolution is SO LOOSELY WORDED that even the torture memo could be turned upon Americans. Do you support that or can I count on you as my representative in the House to do the right thing and speak up stridently among your fellow politicians about this attempt to dismantle our rights?

There is a reason that American's don't grant carte blanche authority to high ranking government officials and it's called abuse of power. It doesn't matter if one is Republican or Democrat, what matters to politicians with any integrity is keeping the spirit of the Constitution alive.

Please speak up and dispel the smoke screens. Carte blance authority is not to be hidden in every resolution until it sneaks through. WE THE PEOPLE deserve more than that, don't we?

121. The federal judge just held that they can't hold the
prisoners at Gitmo without providing them due process and actual trials, not military tribunals.

There are still many that appreciate and uphold the constitution.

It seems that one jusdge already ruled in October 2004 that the detainees had rights, but maybe the "memo" of Gonzales fame overturned that? Then Leon ruled for the Bushits and Green for the detainees.

MILLER of California, Mrs. MUSGRAVE, Mrs. MYRICK, Mr. NEUGEBAUER, Mrs. NORTHUP, Mr. NORWOOD, Mr. NUNES, Mr. OSBORNE, Mr. OTTER, Mr. PITTS, Mr. RADANOVICH, Mr. RAMSTAD, Mr. ROGERS of Alabama, Mr. ROGERS of Michigan, Mr. ROHRABACHER, Mr. ROYCE, Mr. RYAN of Wisconsin, Mr. SESSIONS, Mr. SHADEGG, Mr. SHAW, Mr. SHUSTER, Mr. SIMPSON, Mr. SOUDER, Mr. STEARNS, Mr. SULLIVAN, Mr. SWEENEY, Mr. TANCREDO, Mr. TURNER, Mr. THOMAS, Mr. WAMP, Mr. WELDON of Florida, Mr. WILSON of South Carolina, and Mrs. DRAKE) introduced the following bill; which was referred to the Committee on the Judiciary, and in addition to the Select Committee on Homeland Security and Government Reform, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned
