“necessary to create the conditions” ???

The briefing paper from Blair’s inner circle of July 23, 2002, said that since regime change was illegal it was “necessary to create the conditions” which would make it legal.

How do you create the conditions? By increasing the bombing on Saddam, hoping he would retaliate, and then we could "legally" say we were invading in self defense? But Saddam didn't retaliate. So then what? Go to the UN and pass some ultimatums that required letting all the inspectors back in to the country? But Saddam relented and said OK....but Bush said we didn't have time for the inspectors to look for WMDs. It was too urgent. We had to invade when we did because if we waited, we might see the mushroom clouds.

So how "legal" was it by international law to try and "create the conditions" to make the invasion legal? Were not those actions the real criminal acts of the Iraq?
