WASHINGTON, D.C. -- The Supreme Court ruled Thursday that local governments can force property owners to sell out and make way for private economic development when officials decide it would benefit the public, even if the property is not blighted and the new project's success is not guaranteed.

The 5-4 ruling provided the strong affirmation state and local governments had sought for their increasing use of eminent domain for urban revitalization, especially in the Northeast, where many city centers have decayed and the suburban land supply is dwindling.

Opponents ranging from property-rights activists to advocates for elderly and low-income urban residents argued that forcibly shifting land from one private owner to another, even with fair compensation, violates the Fifth Amendment to the Constitution, which prohibits the taking of property by government except for "public use."

O'Connor was joined in her dissent by Chief Justice William Rehnquist and Justices Antonin Scalia and Clarence Thomas. They wrote that the majority had tilted in favor of those with "disproportionate influence and power in the political process, including large corporations and development firms.""

This will be pure political red meat for the Repugs next election cycle. The "left" wing of the Court saying it's OK for corporations to evict people from their homes. God.....

only to discover that RW judges were opposed to this while our so-called left leaning judges OKAYED IT!! WTH??

I won't assume there's going to be a big rush to push everyone off their property tomorrow.....but the VERY IDEA of such a legal action is just plain wrong.

3. Agreed, Rethugs may try to spin this ruling, but much more is

at stake here than meets the eye. The ruling upholds the presumption that local eminent domain decisions serve a public purpose, and puts the burden on propertyowners to show otherwise.

Clearly, corporations can corrupt governments in ways that are hard to prove in court. But had the USSC ruled the other way, in favor of expansive federal Fifth Amendment property rights, THAT could have benefited corporations even MORE. Every local zoning decision could become a federal case!

Property-rights advocates condemned the Supreme Court's split decision yesterday allowing a local government to seize a home or business against the owner's will for the purpose of private development.

The 5-4 ruling went against the owners of New London, Conn., homes targeted for destruction to make room for an office complex.

7. Does anyone else see a connection to this new ruling, the bankrupcy bill

and the possible popping of the housing bubble and rise in foreclosures in the US or is it just me? If more and more people are strapped for cash, and the value of homes comes down considerably, then the local governments can force people out of their homes with a much lower 'fair market value' offered as compensation. Just saying. All of this seems like a dastardly linked plan to me.

On edit, the more liberal judges on the court advocated for this, maybe they had their constitutional reasons for backing it, which of course the Republicans will capitalize on. Repubs will say the libs did it to you when you are removed from your property even though Republican companies will probably benefit.
