Rumor from RW Source: Rehquist AND Stevens to Retire Tomorrow
In the last half hour the new rumor that is keeping political geeks awake: Rehnquist and Stevens resign tomorrow. (Up until a little ago, the buzz was Renquist, as I noted in Bench Memos.)

I don't know if National Review has any credibility or not, but what I do know is that Stevens retiring under Bush would be a catastrophe on so many levels...

commander in thief now gets to appoint members to the SCOTUS.

So who knows how his health is holding up.

Rehnquist retiring is one thing, but if a liberal jurist like Stevens were to retire, it would be horrible for this country, and coupled with O'Connor's retirement could provide the 5th vote in overturning Roe.

27. His philosophy aside . . .
He was appointed by President Ford -- a Republican -- and he moved to the "left" once on the bench. He is also 85. It is questionable whether he'd attempt to wait for a Democratic president. I wouldn't count on it!

It's not hyperbole to say that this would be one of the worst things to ever happen to our country. Ever. For that reason alone, I could never see Stevens doing that. 85 years old or not, I'm sure he knows the consequences.

Plus, I hear he's still a mean tennis player.

it is almost certain that Rehnquist and Stevens will resign. I figured Bush to get at least 3 appointments this term. If you want an even scarier thought there is an outside chance that he'll get 4!

The consequences of his appointments will start, I believe, at the nominations. Dems may filibuster but if they do I am pretty sure Frist will invoke the nuclear option. So we're screwed any way you look at it. The lurch to the right we're about to take makes me ill.

16. I've heard awful rumors that Ginsberg is in poor health as well
Bush replacing Rehnquist, O'Connor, Stevens, and Ginsberg would ruin this country for decades to come, perhaps beyond repair.

17. I heard that as well, I even heard
that she was much sicker than Rehnquist. I'm not sure I'm buying it but that would really suck to have both Ginsberg and Stevens retire. Kiss Roe goodbye. Is there anything we can do?

there would be enough pressure from his own party to moderate his picks on some of justices.

But counting on Republicans to be decent doesn't help to calm my nerves.

22. Nah...relax....its an easy fix
Replace the GOP Congress.

Impeach Bush.

Allow the international community to put him and his whole administration on trial for war crimes.
.
Increase the number of Supreme Court Judges.

Then make it a requirement that a super majority has to agree to review the future number of judges.

Just think outside the box.....

Multiple Sup. Ct. Justices are not likely to retire on the same day. They are reluctant to "steal each other's thunder," by detracting from the celebrations of their respective judical legacies. There aren't enough pages in a single issue of Time or Newsweek to include stories about the retirements of two different Sup. Ct. Justices
