I don't think a SC Justice would resign while the President is out of the country. It just seems they'd wait 'til he was back.

Whether or not he retires today or tomorrow, we'll have to wait and see if the rumors bear fruit or not.

7. I didn't buy the rumor

Politically, it raises too many problems at once on their side. I'm pretty sure he's putting it off until winter or a year from now- his health isn't, supposedly, that bad that he can't continue on for that long.
