That's what we need by god. Judges who interpret the constitution and not make laws, per the religiously insane.

If the above is true, should not all state constitutional amendments banning gay marriage be ruled unconstitutional? If a judge were being a strict constructionist, per conservative thought, he would discover that nowhere in the U. S. Constitution does it ban homosexuals from getting married. Ergo, per conservative views on the judiciary gay marriages are sacrosanct per our constitution.

Unless, of course, conservatives are hypocrites.

2. If you're willing to trade the new deal, great society, and about 70 years

worth of federal government based on lose elastic readings of the Consitution...sure.

But, a strict reading of the 10 amendment is pretty clear. Anything not specifically mentioned by the Constitution is fair game for the States.
