Regarding Fitzgerald, some grim thoughts from a cynic...

What if Fitzgerald says that the main thrust of his investigation was not to prosecute the person who leaked Plame's identity, but rather to determine whether or not leaking Plame's identity was a crime in the first place?

A lot is at stake with the Plame case. If Fitzgerald doesn't produce indictments of White House officials, the Bush administration will have gained innoculation from future investigations and inquiries. Scary thought.

What worries me is that Rove's favorite tactic seems to be innoculation.

So, I guess what I'm asking is... What are the chances that this Rove scandal might not go our way? 50/50?

1. It doesn't matter
if it wasn't technically a crime. It was morally reprehensible to use a man's wife to publically discredit a former ambassador; to retaliate against a legitimate government critic; to risk endangering the life of CIA operative; to not bother to think through the possible repercussions of his conversation with Cooper. What's worse, apparently Rove (via his lawyer Luskin) seems to think that Cooper did him wrong by using the information.

Leak not and then ye shall weep not.

3. He already looked at it and determined
there was a crime of leaking her identity. That is why the investigation went forward. Now he has to determine the "who" of the leak.

4. So far all the judges have sided
with Fitz. He shows them some classified documents & they agree he can go forward. Even the judge who sympathized with judy 'media darling' miller & seemed to agree she had a case for privilage said she had to reveal her sources. Fitz has something. What, I don't know, but it's there.

My only hope is that the judges aren't siding with someone who is working hard to thoroughly exonerate Rove and company.
