Why should it even be appealed to the court? If Rove is convicted, he'll be sentenced under federal law. It would require a constitutional issue for SCOTUS to hear an appeal. What constitutional question do you imagine the appeal would be based on?
The court refused to hear the Miller-Cooper appeal. It seems likely that the question of journalistic privilege would make it to the court again in the future.
