Average voters have no idea who Thomas and Scalia are, or if they do they really don't understand their judicial philosophy. He said he was going to nominate 'strict constructionists' too. Voters don't know a strict constructionist from a construction worker. So 'the promise' meant nothing. Thats not why people voted for him.

But there is a good comeback for this anyhow. Another Scalia or Thomas on the court could overturn a 100 or so cases going back over a century. Ralph Neas group did a study that shows the kinds of rights that would be lost. I'm sure we'll be seeing that in ads and that should very effective.
