Next month, a House Judiciary subcommittee is expected to consider a simple measure in Congress that would require all legislation to include a constitutional citation of authority.

Sponsored by Rep. John Shadegg, R-Ariz., the one-paragraph proposal's operative sentence states, "Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act."

Called the Enumerated Powers Act, this is the measure's fourth introduction into Congress. H.R. 175, this year's version of the proposal, currently has 26 cosponsors.

Shadegg said he introduced the measure "to continue the fight against a federal government that is too big and is involved in too many areas which are beyond its constitutional authority. The federal government can no longer ignore the 10th Amendment and run roughshod over the rights and authority the Constitution preserves to the states and to the people respectively."

1. As described, it doesn't sound so bad, but I'm suspicious.
e.g. USA PATRIOT Act etc. wouldn't survive such.

Where's the right-wing exploit? I'm sure there is some, but I'm a bit too groggy to smoke it out.

3. Reich wing radio was talking about Social Security being unconstitutional
and that had this act been around it would've been declared so when it was proposed.

I'm sure they see the Patriot Act in the Constitution.

You see they see what they want to see in the Constitution and if they don't like it they don't see it.

200 years of case precedents be damned.

7. "Commerce Clause"
seems to be the all-purpose constitutional justification. Of course it depends on what you define as "affecting commerce" that defines what laws would be "constitutional."

There is some dicussion of Roberts viewing the Commerce clause very narrowly which would mean that he would vote to throw out lots of things such as environmental regulations. I'm sure the wingnuts' purpose with this "Enumerated Powers Act" is essentially the same.

5. Amendments to the Constitution obviously would be unaffected by this act
Because if you can only pass laws that have constitutional justification, then the only way to pass other laws would be to pass an amendment.

Of course staying it is constitutional does not make it constitutional.
