can be made out of session anyyway?
Please- this is a real question.
If a president can make appointments by running out the clock, why do we even have confirmation hearings?
If this is hpw it worksthen why waste time and money. The congress and senate could be working on other things.

that part of the constitution is a bit out of date
it was intended for a time when the fastest mode of transportation was a horse. it took a while to get people together in congress and it took even longer for ambassadors to travel to other countries.

But the makeu-up of the Senate could be different by 2007, when the appointment expires.

Maybe the Democrats should just refuse to vote on any appointments from now on and say the President can just make recess appointments.
Or they could call the Bolton recess appointment and "unusual circumstance" and then fillibuster away.

...Frist (as shrubs puppet in the senate) refused to allow an vote thus dragging out the process to the end of the session where pResident Bush immediately made the appointment after congress adjourned claiming that the democrats would not allow such a vote to take place.
If not politics, then Dubya is rehearsing to be dictator and supreme emperor.

Do those rules also apply to the Supreme Court. Could Bush just appoint Roberts to the Supreme Court for the next year and a half, or do judge appointees go by a different set of rules.
