Toad case may reveal Roberts' philosophy
Appeals court vote may show inclination toward states' rights

WASHINGTON (AP) -- A toad may offer insight into John Roberts' legal philosophy.

The Supreme Court nominee voted against the amphibian in a 2003 case testing the powers of the federal government.

In that case, Roberts suggested that federal power is limited, urging the court to reconsider its decision restricting a San Diego area construction project because it encroached on the habitat of the rare arroyo southwestern toad.

He questioned whether "a hapless toad that, for reasons of its own, lives its entire life" in one state could be regulated by the federal government. His view did not prevail.

based on the criminal manipulations of his useless brother in Florida based on a Supreme Court decision with no precendent that sets no precedent.

The "Rare Aroyo Southwestern Toad" stops John Roberts! :wtf: Is what they'll say...

I know what you mean, but the majority of Americans won't be able to.

3. Agreed...the slant of the article is what's important...and...
ALSO will be missed by most Americans. They're just using the incident as a means to illustrate his thought process, but Bush will just keep leaning on the "he's a GOOD man who won't legislate from the bench" rhetoric.

4. Add to that anger over med marijuana & emminent domain...
...and it makes the argument that Roberts is dangerous because he wants to limit the scope of federal power that much tougher to argue.

But telling rural Alabama that John Roberts isn't a friend of rare southwestern toads will make them fall in love with him.

They will interpret that article that way. Believe me, they TRY to be fill their mind with BS. They long for it!
