Diebold is being questioned in San Diego
Apparently two precincts' votes are being recounted by hand. Does anyone have more specific info on this?

"Now, a nonpartisan citizens' group that conducted a parallel election has requested a recount of 11 precincts. This time, the issue isn't unmarked bubbles, but the accuracy of Diebold Accu-Vote optical scan voting machines and the Diebold GEMS central tabulator used to count votes.

The Citizens Audit Parallel Election (CAPE) asked voters exiting polls to vote again and sign a log book attesting to the accuracy of their second vote. Sealed parallel election ballots were counted at KGTV's studio with a TV camera crew filming the counting process.

Nearly 50 percent of all voters participated in the parallel election, which included five polling places representing 11 precincts. The sample included more conservative than liberal precincts, with participation as high among Republicans as among Democrats. The tandem election results showed what most feel to be startling results.

"There is a shift of four percent of the vote, consistently," Joe Prizzi, (engineer and physicist,) reported at a press conference held by CAPE in front of City Hall. Frye received 50.2 percent of the votes cast in the parallel election - enough for an outright victory if those results reflect the outcome citywide. CAPE also found that the official count added approximately 2 percent to each of Frye's two Republican opponents, Jerry Sanders and Steve Francis.

In addition, CAPE examined the only other ballot measure, a proposition over a war memorial cross on public land. The proposition's vote total also appeared to have been padded by 4 percent in the official election tally, which was certified Friday August 19 by San Diego County's newly appointed Registrar of Voters, Republican Mikel Haas.

Math is non-partisan

A team of statisticians from California State University- Northridge - have analyzed the data from CAPE, concluding that the probability of luck or chance as the cause of the observed four percent deviation is less than one in 1,300 - or .000678.

Activists suspect fraud. "I am troubled by the prospect that we are losing our democracy very quickly. We've been voting on machines that were never intended to be tools of democracy," said Brina-Rae Schuchman, media spokesperson for CAPE, noting that Diebold machines utilize "secret software."

11. FINALLY....SOMEONE
was using their brains, and took action....and IF I recall correctly...when AAnold was elected...there was something about him only being elected overwhelmingly in 7 counties that used electronic machines, and that those 7 counties delivered the whole state...I know I read an article about it...but, of course, after reading the initial story, I didn't hear any more about it...perhaps that is actually why this happened..good for them...

San Diego Democratic mayoral candidate, Donna Frye, may have been robbed of her mayoral seat in the July 26 local election as citizens' audit parallel election vote shows shift of 4 percent, Raw Story has learned.

Frye, who served three years as a council woman in San Diego, California, previously ran as a write-in candidate in November 2004, but was deprived of San Diego's top seat due to the city's Registrar of Voters, Sally McPherson, blocking the count of 5,547 ballots on which voters had written Frye's name, yet failed to also fill in bubbles. The disputed ballots would have given Frye a victory by 3,439 votes.

Hopefully in November, the surfer lady (I forgot her name :7 ) will have a clear victory! :toast:

I can't believe they tossed all the write-ins for her after the first election just because people didn't mark an 'x' next to her name. Geez.. they clearly wrote her name in..

She's already won once.. :crazy:

21. 11 precincts, requested by the Citizens Audit Parallel Election(CAPE).
Someone below has posted a link to the article on this at rawstory.com.

The 11-precinct recount began today. But so far, I'm told the recount matches the machine count. That doesn't mean the machines were accurate, though--since the Registrar failed to seal the ballots for the past two weeks! Unbelievably, there are no criminal penalties for this sort of thing, nor can the City be sued for election problems under its charter.

Then there's the matter of a 1% hand recount required by law (not the same as the larger recount CAPE requested). The Registrar ignored requests by CAPE to witness the 1% recount, instead conducting it in secret. When activists complained, he reportedly quipped, "What was I supposed to do, send you a gold-plated invitation?" There is also a question of just how "random" that recount was, as he seems to have selected the smallest possible precincts.

It's all very disturbing and depressing for anyone seeking assurances that our votes are not being stolen.

29. Key question, how many precincts are being recounted?...
and, MORE IMPORTANTLY, if it isn't all of these 11 precincts that are being recounted, how is the subset being determined of what they are recounting? Is it random or is it "hand selected" by those in charge. If the latter, we could have a repeat of what happened in Ohio!

The first post indicated that two precincts were being recounted. I'm hoping they are meaning that two "so far" have been recounted.

And I truely hope that there is an anomaly found here too. If there isn't, that could actually be damaging and used to rule out other discrepancies with exit polls as not being something to get alarmed over. I hope that those who looked closely at these statistics really were confident that something was wrong. If no wrongdoing is found, it could do more damage. On the other hand, if there is found to be problems, that could mean everything to the rest of the country moving forward in future elections in making sure we get election fraud protection in place. Perhaps even get a recount of Hackett's race in Ohio!

30. I don't know where the first poster got two precincts,
unless they're referring to the 1% mandatory hand recount. That's different from the recount requested by CAPE.

The parallel election folks (CAPE) are recounting all 11 questionable precincts, and I'm told they may add more.

42. There actually are paper ballots...
They are "scanned" in. The point of contention is the machines that are scanning them in and how these votes move to the central tabulator machine. As noted from the earlier incident with BBV's Jim March being arrested, the central tabulator was set up in such a way that observors were to far away to be able to see what was going on on the screen, and were denied requests to have this machine moved closer to their scrutiny. Also an issue was that against local election rules, the machine was hooked to the internet.

A hand recount of these paper ballots would hopefully identify if there were shenanigans with how the paper ballots were being scanned and/or how cumulative counts might have been manipulated. San Diego still hasn't gone to the completely paperless touchscreen machines yet. That in my mind is why it is SO important that they can show substantively some problems with the way Diebold is accumulating totals, as other voting systems that might be used now don't have a means to do hand recounts.

If it can be shown that their system is flawed, and perhaps HAS been abused in this case, that would be a cause for general alarm for all Diebold systems (and other evoting systems) nationwide, which would give us the opportunity to force healthy reform on them in the future.

I'm actually less concerned about whether the hand count will generate results where Donna Frye gets a majority or even if we can get the more beatable Steve Francis in instead of Sanders. Twould be nice if either of those could be made to happen from the recount, but Donna can still win the general election, and if it is shown that there was cheating, that would help her that much more in the November election. More importantly though, it would help many other elections moving forward enforce more strict standards on what is allowed for e-voting machine contracts.

If however, no substantive problems/voter fraud can be found with this recount though, it might make it that much harder later to get evoting reform through, as the companies will point to this "false alarm" as an example of why much of the concerns others have aren't valid.

That's why it is SO important that we make sure that this recount isn't abused. Have to DEMAND random sampling and not selective sampling for us to recognize this as a valid recount.

when results will be counted by repukes and refuse to endorse a paper-trail machine if paper ballots aren't brought back in view of problems since their being installed!

Diebold receipt at ATM's but not nescessary for election to the President especially after Ohio fiasco?!!

SAN DIEGO -- It looks like last month's San Diego mayor's election is headed for a recount.

Unlike the recount last November, this one is not about filling in the bubble next to the candidates' name.

Instead, it's about the accuracy of the voting machines.

An organization called Citizens Audit asked people in 11 precincts to vote a second time as they left their polling place.

They then compared their results to the official results and believe there is something wrong.

They will make their recount request after the official results are certified, probably within the next two weeks.
