There may be an impending crisis, only 2 DREs are HAVA compliant and are eligible for HAVA money. The Acupoll and the Liberty DREs. All Diebold, Sequoia and ES&S DREs do not have 2002 certification and cannot be used in the upcoming federal election in 2006 according to HAVA section 301.

8. Well, that's great and .... basically, irrelevent

The lack of certification or HAVA compliance hasn't stopped anybody from using the damn things so far, and yes, there've been plenty of appropriate, legal reasons they didn't pass the muster. The Diebold-loving (read: bought and paid for, IMO) states just went right on with their business as if nothing was wrong. Or maybe they made up a special certification or something.
