If confirmed as the most senior member of the federal judiciary, Roberts could roll back 70 years of hard-won social justice progress.

People For the American Way had opposed Roberts' nomination to replace retiring Justice Sandra Day O'Connor based on his record of hostility towards civil rights, the right to privacy, and the separation of church and state.
This record make his confirmation as chief justice -- a position with influence and responsibilities that exceed those of the eight associate justices -- an even greater threat to Americans' rights, freedoms, and legal protections.

For many Americans, the catastrophic damage caused by Hurricane Katrina made last week one of the most difficult in recent memory. With the immense suffering and human need still before us, it is difficult for the country to focus on the enormity of what is at stake in the selection of Chief Justice Rehnquist's successor at the same time that we replace retiring Associate Justice Sandra Day O'Connor. There should be no rush to confirm their replacements without the full attention of the Senate and the American people.
The chief justice has unique power and influence as the nation's highest-ranking judge. And replacing two justices at the same time will have an enormous impact on the Court and on Americans' lives and liberties for decades. Given these stakes, President Bush and John Roberts must be held to the highest standards of openness. The President must stop withholding the documents from Roberts' tenure as deputy solicitor general in the administration of the first President Bush. Roberts must fully answer senators' questions about his interpretation of our Constitution and abandon the evasive tactics he used when nominated to the DC Circuit Court of Appeals. Excessive secrecy is an enemy of accountability and an enemy of representative democracy.
The Senate makes few decisions more important to our country than choosing a new chief justice of the United States. If confirmed as the most senior member of the federal judiciary, Roberts could roll back 70 years of hard-won social justice progress. He is the wrong choice to be the chief guardian of our rights and liberties.
