"Senate candidate Coburn denies malpractice

ANGELA ROSSON, APPELLANT,
v.
DR. THOMAS A. COBURN, APPELLEE.
" In addition to Rosson's testimony that Coburn failed to advise her and obtain her consent to the procedure which rendered her sterile, she also testified as to damages, including that she wanted to have more children. The record also reveals testimony of a medical expert that Coburn's performance at the time in controversy was a departure from the standard of care and that it was the proximate cause of Rosson's condition of sterility. This evidence, taken in the light most favorable to Rosson, was sufficient to establish a cause of action for medical malpractice...

32 We find the trial court did err, however, in dismissing Rosson's first cause of action alleging battery, and in sustaining Coburn's demurrer to Rosson's evidence on her second cause of action alleging professional negligence."

"Let's not forget, there's a pretty serious cloud hanging over Coburn's medical record.

According to records obtained by Salon, Coburn filed an apparently fraudulent Medicaid claim in 1990, which he admitted in his own testimony in a civil malpractice suit brought against him 14 years ago by a former female patient. The suit alleged that Coburn had sterilized her without her consent. It eventually was dismissed after the plaintiff failed to appear for the trial. In his sworn testimony, Coburn admitted he sterilized the then 20-year-old woman without securing her written consent as required by law. He blamed the omission on a clerical error, but maintained that he had her oral consent for the procedure. (Salon has been unable to contact the woman and is withholding her name out of respect for her privacy.) Coburn also revealed under oath that he had charged the procedure to Medicaid — despite knowing that Medicaid, also known as Title 19, does not cover the cost of sterilization for anyone under age 21."

"Woman counters Coburn on forced sterilization
Friday, September 17, 2004

A women who was sterilized by Republican U.S. Senate candidate Tom Coburn said he acted without her consent.

Angela Plummer sued Coburn for medical malpractice and fraud. She said she never asked to be sterilized even though she had a difficult pregnancy and one of her fallopian tubes had to be removed.

Coburn removed the other one without permission, Plummer said. He then told her and her mother not to talk about it because the procedure was not covered by Medicaid for people under 21. Plummer was 20 at the time. "
