England says love prompted abuse photos

Isolated amid the chaos and often bizarre life inside Iraq's Abu Ghraib prison, Lynndie England posed in now notorious abuse photographs because she loved and trusted the scandal ringleader, her lawyer said at the start of her court-martial.

England, 22, who was pictured holding a leash to a naked Iraqi prisoner, was lured into posing for the photographs that caused worldwide outrage by Charles Graner, the father of her baby, said military attorney Capt. Jonathan Crisp.

"What mattered to her was her relationship to Corp. Graner," said Crisp, who added that Graner was her superior officer, was 14 years older than England and had worked as a prison guard.

"She thinks: 'I love him, he loves me, he's not going to do something to hurt me,'" Crisp said in opening arguments. The Army reservist faces a maximum penalty of 11 years in jail if convicted on all seven counts on charges of conspiracy, maltreatment of subordinates and indecent acts.

3. I wish people would take a closer look at those photos.

Please don't flame me, I'm not defending the actions of those respnsible for abusing the prisoners at Abu Ghraib. I just think those photos look--questionable.

4. If this were proven to be true,

the only way this being possible would be via the work of psychiatrists, I'd say it's obvious that Lynndie England ought to be pitied more than vilified, as it seems symptomatic of some form of mental instability.

5. Lisa Dunn

She was a defendant in a mass murder case in Kansas (which was part of a larger multi-state murder spree in the mid-80's). She was originally convicted in Kansas of aiding and abetting the principal but later (excerpted below) she was retried and acquitted. At issue was her mental state at the time of the crimes and whether it lowered her culpability. She was controlled by her lover. In otherwords, there is some precedent for this type of defense.

in 1991, a federal district court judge overturned Dunn's conviction and ordered a new trial. Because she was charged with aiding and abetting Daniel Remeta, her mental state was a key component to her defense, the court ruled, and the trial court erred by not providing Dunn with an expert witness. The State of Kansas quickly appealed to the 10th Circuit Court of Appeals, which upheld the lower federal court ruling. The 10th Circuit's ruling on compulsion and the "battered-woman defense" significantly reshaped how courts look at battered women who commit crimes.

The Dunn decision "extends the use of the battered woman syndrome beyond situations in which a defendant uses testimony about the syndrome to justify her actions and relieve her of culpability," wrote Kimberly Kuhn in the Toledo Law Review. "(Now a) defendant may use testimony on the battered woman syndrome to prove her innocence when charged with a specific intent crime."

In 1992, Lisa Dunn went on trial a second time. Like James Hunter, this time Dunn was able to present a formidable defense of compulsion, complete with expert testimony about why a battered woman with ample opportunity to flee a hostile environment "chooses" to stay with her batterer.
