40 House members sign on to state bill banning abortion
CHANGE IN LAW STARTS WITH 'CHALLENGE,' LEGISLATOR SAYS

By Joe Biesk
ASSOCIATED PRESS

Some Kentucky lawmakers are trying to ban abortion, even though such a prohibition would probably conflict with federal law and the 1973 case, Roe vs. Wade, that gave the procedure its current legal status.

Nearly 40 House members have tagged their names to the plan, sponsored by Rep. Addia Wuchner, R-Burlington. Wuchner acknowledged that if the General Assembly passed the ban, Kentucky would be at odds with the federal government.

But it would "create a challenge" to federal law, Wuchner said. "That is how change begins, and it begins right here at the state level," she said.

Under her plan, a woman would be legally pregnant starting at fertilization. Birth-control pills and other contraceptives would remain legal.

Gov. Ernie Fletcher has "always been a strong supporter" of such legislation, said his spokeswoman, Jodi Whitaker. However, administration officials had not finished reviewing the plan, she said.

6. So, basically, while the percentage is high, it's not enough
to actually pass this idiotic piece of "legislation."

I hope.

How many Vichy Dems are their in Kentucky? I'm in Tennessee, so this move really both interests and scares me. Our House make-up is very similar.

4. Looks like Rove strategy. Get the Rapture right to vote en mass for
crooks and liars, then let DIEbold do the rest. The Anti Gay Marrage amendment is next again, plus around June (my Guess) there will be a slew of fake terror alerts and a big number of number 3 guys of Al Qaeda getting arrested or blown up. Fake number three's of course.

5. Great idea, Kentucky.
Edited on Tue Feb-07-06 07:07 AM by Dangerously Amused

You're one of our wealthier states. You can certainly afford to donate substantially more tax dollars to help feed, shelter, clothe, school and otherwise raise the children whose mothers knew they couldn't afford to give them a decent life, but whom you forced into the world anyway.

What's that? Bush is cutting welfare again to help pay for his illegal war? Huh. Guess baby doesn't get fed today. Too bad for baby. Maybe baby's mother shouldn't have had baby if she couldn't afford to feed him. :eyes:

George W. Bush's NEW slogan: FIGHT 'em over there and FUCK 'em over here.

7. Roe (Casey) & Griswold are toast
It's a done deal- thanks in no small part to the DLC Dems.

All the states are doing is racing to see which one gets its name on the case that does it.

KENTUCKY GENERAL ASSEMBLY
Bill would outlaw most abortions
Measure intended to test Roe v. Wade
By Peter Smith

snip ....

The bill, filed Wednesday, would have no effect if it became law. That's because the U.S. Supreme Court declared abortion to be a constitutional right in its 1973 Roe v. Wade decision, overriding state laws to the contrary.

snip ....

This bill -- and similar legislation pending in Indiana and a handful of other states -- appears to be designed "to provoke a challenge to Roe," said Elizabeth Nash, a public policy associate with the Washington-based Guttmacher Institute, which tracks such issues.

snip ....

A 1982 Kentucky statute declared the legislature's intent to ban abortion if Roe is overturned by either new judicial decisions or a constitutional amendment.

snip ...

Marcosson, who teaches constitutional law, said there is "zero" likelihood the current Supreme Court would reconsider Roe based on the Kentucky bill. The court, however, could have more justices willing to overturn Roe by the time a lengthy appeals process over a Kentucky law concluded.

Much more at link ....

In this session, the Legislature is also considering headgear for ATVers and a seventy-mile-per-hour speed limit, so it isn't surprising that they're offering this head-first approach.

...O...
