Weapons confiscation after Katrina
(This is not a chat for or against gun control, it is an example of how "conservatives" deal with state's rights.)

After Katrina, law enforcement in and around New Orleans (including heavily republican St Tammany Parrish) started confiscating weapons from citizens.

Per Louisiana STATE statute title 14, 329.6 provides (amongst other things) Proclamation of State of emergency

(6) regulating and controlling the possession, storage, display, sale, transport and use of firearms, other dangerous weapons and ammunition.

Per state law, the state of emergency should have been advertised in local papers. It was not. Immediately after the hurricane newspapers were not publishing printed copies. And there is the argument of prohibiting vs regulating and the definitions that entail.

The NRA with their panties in a wad are pressuring the STATE legislature to change this caveat to ensure "it never happens again" and they will most likely get their wish. Right or wrong is not my argument.

When it comes to Slavery, Gay Marriage, Abortion, by god according to "conservatives" states rights are sovereign.

I so look forward to the next hurricane, when, if the NRA gets their way, all the bubba's in SE Louisiana will be loaded for bear just waiting to shoot anything that he might think is a threat to his property.

1. LA militia includes all persons between 17 and 64. The Governor can call
the militia to perform various duties including law enforcement.

LA law says, "The governor may order into the active service of the state any part of the militia that is necessary to provide for homeland security or emergency preparedness or in the event of insurrection, invasion, or riot, or imminent danger thereof, or in the event of public disaster or danger from flood, fire, storm, earthquake, civil disturbances, terrorist events, or in order to detect, prevent, prepare for, investigate, respond to, or recover from any of the foregoing, or to assist the civil authorities in guarding prisoners, or in response to a national or state emergency or a congressional authorization or presidential declaration pursuant to the War Powers Resolution (50 U.S.C. 1541 et seq.)."

It would be nice if the militia when activated were armed and the primary source of arms would be personal.

2. Forget the 2nd Amendment to the Constitution? It used to give......
......people the right to own guns but of course we all know what Bush has done to the Constitution of late.

On top of that Bush don't want his neocons facing rightful retribution from the common man that his bunch is screwing over.:grr:

9. 2nd does not give RKBA, it obligates government to protect an inalienable
right, the right to keep and bear arms, as stated by Pennsylvania in its constitution in 1776, "That all men are born equally free and independent, and have certain natural, inherent and inalienable rights, amongst which are, the enjoying and defending life and liberty, acquiring, possessing and protecting property, and pursuing and obtaining happiness and safety."
And
"That the people have a right to bear arms for the defence of themselves and the state; and as standing armies in the time of peace are dangerous to liberty, they ought not to be kept up; And that the military should be kept under strict subordination to, and governed by, the civil power."

4. This has slipped under the radar screen
and it needs to be repeated loudly and often. I have a dozen close relatives for whom gun control is the ONLY issue they actaully agree with repukes on and yet they vote for the asswipes every time. I gotta believe there are millions of folks out in Jesusland who will just fucking freak if they hear this.

10. The media has not reported the incidents thoroughly and the facts are not
known. It appears that both Republican and Democratic elected officials were involved in confiscating the guns.

6. I'm surprised I haven't heard more about that.
It's outrageous that guns were confiscated and it should show the gun nut crowd that it's the pukes that are truly after their guns, not us.

7. Well it was equal opportunity confiscation
The NOPD (New Orleans Police Department) rounded up a bunch of weapons and so did the St Tammy Parrish Sherrif's Office and I think it is fair to say that both organizations were working under the auspices of STATE law. I just don't see where the NRA has a dog in this hunt. And it obviously shows a "conservative" disdain for state's rights. Imagine that! However, I predict that the state law will be altered to make the NRA happy.

8. Why shouldn't the NRA have their say?
Not really commenting on the issue either way, but I interpret your post to mean that a 'national' organization should stay out of state-level (and by implication local-level) issues. I don't agree - organizations like this may be made up of members from across the country, and may often work at the federal level, but there's no reason they shouldn't represent their members' interests at smaller scales. I wouldn't expect the NRA to stay out of state affairs any more than I would expect NOW, PETA, The Nature Conservancy, the NAACP, or any other national organization to do so...

I agree that "state's rights" is often trumpeted by RWers out of convenience more than conviction, but I don't think this case is a particularly good example of conservative hypocrisy (not compared to the plethora of better examples, anyway).
