Check out the woman in the yellow shirt, her behavior is unbelievable. She's practically got her sign on the guy's head, and when the man in the red shirt tries to move her back a few inches, she grabs at his shirt and shoves him over and over.

These people need to learn some manners...

BTW, sounds like the old guy's saying, "Go Nick Pelosi" -- he probably should have picked a different phrase. :)

23. I would add that I think Lampson should've stopped the rally
called the police and resume when the police had the protester's under control and he could speak without being interrupted, his people could stand with signs without being harrassed.

If you allow this behavior -- at all, any time -- it emboldens them. Bullies must be stopped with force.

Now, how do we get to a better state?

Allowing someone to talk over you will make you appear ineffective, not worth listening to. So, get control of the situation, and then deliver your message.

The police exist (ideally) to protect the rights of the people. It is far better that they work to defend the right of the people to speak freely, than that they work to defend the right of the powerful to speak freely (and keep the people in a 'free speech zone' down the street).

I was wondering the other day about WHY does the U.S. have these kind of low lifes. This is the 21st freaking century! I can only partially conclude it is a hang over from the 'wild west' and settlers of the country. It would be hard to believe that any other civilized country contains the level of miscreants we do.

It may get worse, folks. Some of them are going to be protesting when the felonious Bush Cabal is brought to its knees. hehe ..

36. "Assault" can be just a threat of violence, even with NO contact.
It's usually a misdemeanor.

"Aggravated Assault" is more serious--& a felony. I believe that "Assault & Battery" is another way of saying "Aggravated Assault."

40. SHE committed assault. HE committed battery.

As stated above, it does not take much to constitute legal assault. Battery is the more serious crime. All it takes to commit assault is to get in someone's face screaming at them. Which it appears the woman is doing in that video before he pushes her away.

Though battery is the more serious crime, a judge in this case would probably give out equal sentences since her assault prompted his battery.

And since someone will probably reply to the affect, "then why aren't people being arrested for assault everytime two people get into an argument," I will go ahead and answer. If two people are arguing then BOTH of them are committing assault. If one insists on pressing charges, the other will do in turn, and then BOTH are going to jail. So as a rule, neither party presses charges.

Which is why you won't see anyone pressing charges in this case.

47. Not necessarily.....(I know this is just a goofy side issue).....
usually the elements of an assault include the reasonable expectation of someone becoming the victim of a battery; the assault more or less is the vocal part and the battery the physical part. Most often, for it to be an aggravated battery, other elements are needed as well. For example, if she clocked him with a steel pole. But he probably did commit an aggravated battery on her because of her age. Usually striking an elderly person is an element that meets requirements of aggravated assault.

So the woman is probably not guilty of assault - the jerk that hit her probably had no fear of being the victim of a battery. If anything, she is probably barely bordering on disorderly conduct, but that is even doubtful because it is expected for people to get vocal at a protest.
