For Bush, 'executive privilege' excuse shouldn't fly:

Numerous top aides have testified before Congress.

“Dan Bartlett, counselor to Mr. Bush, has said it is ‘highly unlikely’ that the president would waive executive privilege to allow his top aides to testify publicly. One Republican strategist close to the White House…said: ‘No president is going to let their senior staff assistant to the president go testify. Forget that. They might agree to do an informal interview, but they’ll never testify.’ … Democrats, citing a report by the nonpartisan Congressional Research Service, say presidential advisers, including 47 from the Clinton administration alone, have frequently testified before Congressional committees, both while serving the president and after they had left the White House.”

1. This is where that good old hypocrisy kicks in.
It's OK for someone else, but not for us.

The GOP makes the rules to suit their needs, everyone else is expected to do as they say, but not as they do. Because if you do the same thing the GOP does and get caught, it's illegal.

When they do it, they're fighting the war on terror.

A war they created so their cronies could get richer.

2. Do you have a link to the CRS report?
The legal question is going to be different from the popular question. I don't recall any of Clinton's 47 ever being forced to appear under subpoena.

The way these cases have historically worked is the congress demands and the White House refuses, then they negotiate something in between. Rarely does it actually make it into the courts.

4. You can access the CRS by googling; looks like a lot of .pdf
files, so I wouldn't be able to copy chapter and verse for you. If I see a link, I'll post it.
