Is Hillary planning to give up her seat if she gets the nomination?
Kerry ran without giving up his seat, but I thought a while ago I heard Hillary was going to give up her seat if she runs. when is this normally done in the process? would she do it if/when she gets the nomination?

has she made any statements about this?

(not the only reason i'm asking but as I understand Bobby Kennedy might run for her seat if she gives it up)

1. No. Kerry and Edwards kept their seats last time. Only Dole did this in 96.

. . . and there's an election in 2010 to fill the remainder of the term.

4. No, Edwards' term was up
And, he decided early on that he would not run again for his seat. In fact, he decided that before he began running for President during the primaries.

He was totally focused on the presidential election and didn't want to run for both the Senate and President (then later VP) at the same time.

8. He didn't give up his seat for the remainder of the term he was already
serving. He didn't run for re-election. He and Kerry were in different situations - as Kerry's term wasn't up. (It is in 2008 and one consideration he had was that he could not, under Massachusetts law run for both at the same time.)

11. Not True
Edwards did not give up his seat. He was fully focused on the campaign and therefore abandoned his duties. This is one of the reasons Edwards lost NC. He promised before being elected that the NC senate seat was not a stepping stone to run for President and promised NOT to run for president while an NC Senator.

I live here and worked on the senate campaign. The stuff you heard about him, that NC folks called him Senator "GONE" is true. Many dems were very upset. Just ask yourself, DID HE WIN NC? I will get the link for you.

If its McCain and he says he will give up his seat (which is his until 2010) before the election, than she proably will be pressured to do the same thing.

In all likelihood, neither will do that.

on edit: also should point out that JFK didn't give up his seat when he ran in 1960 (he had been reelected in 1958).

Some states permit a candidate to run for both US Senator and President or VP

I don't believe this matter in NY as Hillary's next US Senate election is in 2012.

9. Depends on when her term is up
If it's up in 2008 and she gets the nomination, she might have to not run for reelection to the Senate. But if it is up after that, there isn't much of an issue I guess. If she becomes President, Spitzer will appoint someone else. If not, she can run again for Senate.
