Clarke Asks Anti-Bush Group to Pull TV Ads (Moveon ad)

WASHINGTON - President Bush (news - web sites)'s former counterterrorism adviser complained Wednesday about the use of his name and comments critical of Bush in a new broadcast advertisement from a political group supporting Democratic candidate John Kerry (news - web sites).

Richard Clarke said he instructed his lawyer to ask the MoveOn.org Voter Fund to pull the ad, which Clarke said was created without his knowledge or permission. The group said it rejected the request.

"I just don't want to be used," Clarke told The Associated Press. "I don't want to be part of what looks like a political TV ad. I'm trying hard to make this not a partisan thing but a discussion of how we stop terrorism from happening in the future, keep this on a policy issue. I don't want this to become any more emotional or personal than it has already."

Moveon should have gotten permission from CBS and Richard Clarke. Im not sure if this helps or hurts Clarke. Nice example of corporate media whorism via the title by the way.

3. I think it helps both ....
Clarke says "...I'm trying hard to make this not a partisan thing but a discussion of how we stop terrorism from happening in the future ..." and keeps himself above the fray, but also draws attention to Moveon.org and the ads.

13. It's good for both
He distances himself from partisan politics and takes the high road. Makes him look good and refutes some of the attacks against him.

MoveOn gets extra press and gets his statements into homes everywhere.

They should keep airing the ads and he should ocassionally voice his dismay at it. Kerry should make a statement about it too. Keep the whole Bush failed thing in the public eye as often and in any way possible.

Kerry could end up looking fair and statesman-like, Clarke as a principled man unsullied by party politics, and MoveOn can keep Clarke's words right there for everyone to hear. Everybody wins (except the chimp).

6. Clarke's testimony is in the public domain.
It's that simple. And video from '60 Minutes', if brief, can be used under the 'fair-use' doctrine.

9. Don't agree, NBC had Bush pull an ad that featured MTP footage, copyright
A spokesman for CBS said the network didn't know about the ad.

"CBS News was unaware that MoveOn.org was using CBS News copyrighted material without permission and to advocate a point of view," spokesman Kevin Tedesco said. "We are exploring our options."

I think MoveOn is within its rights. The transformative factor has weight here -- and actually works against CBS's case, not in favor of it as Tedesco implies.

the clip...I've heard it and it's a great ad, but it seems someone could have said, How's Clarke feel about this?

ads, including this one. But, he is a human being under alot of pressure right now.

but moveon should pull this ad.
and it won't help kerry right now -- since a linkage between the two is what bushco is looking for.

I was surprised as well when I saw Clarke in the Move-on ad. The point has been made. They should honor Clarke's request and pull it.

I also agree that Kerrey shouldn't have done AA today.

All the right-wing nuts and even regular media are already accusing him of being partisan and are questioning his motives. His testimony will be most powerful if he is not affiliated with any left-leaning or liberal group.

Darn. I really liked the ad, though.

On edit: I agree with Hippiechick. I didn't even think of that. Vigorously distancing himself publicly from moveon.org will give him credibility and draw more attention to moveon.org.

Public figures don't get to say where their images, or even their words and voice, show up under fair use limitations.

If they did, most political ads would be out the window. Bush could complain he didn't like his voice being used in a Kerry ad.

CBS is "examining their options" because their lawyers all told them it was just too bad; if they had something actionable, they would have gone to it by now.

HOWEVER, from a PR perspective, as was said earlier this couldn't have gone better. The ads gets more attention, Clarke gets to protest the politicizing of his situation by the left, bolstering his own reputation with the only people who don't already love him -- the GOP voters. MoveOn, if they decide to pull the piece, gets to issue a press statement that will get airtime everywhere, where they get to volunteer to remove the ad "out of respect for the service of this great man who has done so much to try to fix a bad situation, namely Bush's failures..." etc. etc. etc.

Put it in the "win" column for the good guys. :thumbsup:

he is already trying hard to look as non partisan as possible and i think he is doing good, but this ad does not help him. i liked the ad, but they can make many other good ones.

31. sounds like something he said in public, thats fair game
public comments from a public figure are in the public domain so Clarke's permission is not required. same as when one party lifts excepts from the other guy in ads.

as a non partisan attacker. It's more difficult to question his integrity and motivations that way.

I'd say they should pull it.
