Why then, because Burris is black, is Reid's refusal to accept supposedly based on Burris' blackness? Gimme a break!

on edit: I think Reid has botched this whole thing completely, but this has simply nothing to do with race.

Anyway, the Constitution actually reads that the Senate has full discretion as to whom can enter their ranks.

8. No, it doesn't.
The senate only has discretion as to who SERVES. The senate has no authority to turn Burris away. But the senate can, one minute after he is sworn in, vote to expel him.

9. Yes, under the senate RULES, he needs a signature. They can use that to stall for time.
But as an overall matter, they don't have the right to just exclude anyone for any reason. That is unconstitutional and an infringement on a state's right to send their own representative to Congress. Here you have the senator from another state deciding who shall and who shall not represent another state on a basis totally above that body's constitutional authority.

But yes, Burris needs to get the signature according to the senate's rules. But the senate's rules aren't constitutional or even law. They're administrative/procedural rules for that particular body.

5. Reid didn't do a damned thing today, the Secretary of the Senate rejected
the credentials for a valid reason.

Burris needs to go back and get Jesse White's signature on the certificate of appointment. It will be only then that Reid enters into the equation.
