Sen Jon Kyle to Dems: "You will not sit Franken any time soon"

Senate Minority Whip Jon Kyl has warned Democrats not to try to seat Al Franken any time soon, and he predicts the legal process will take at least a month to unfold, meaning the Senate may be stuck with 99 members well into February.

In an unusual move, Kyl went to the Senate floor this morning to lay out all the reasons why the Minnesota Senate election remains unresolved, and he listed Sen. Norm Coleman’s arguments before the Minnesota courts. Coleman’s election lawsuit contends there are newly discovered ballots, missing ballots, wrongly rejected absentee ballots and double counting of votes.

So now Pawlenty, SOS Mark Ritchiw have told Franken "no" they will not certify him and denied his request for a certificate.

whether it helps Franken or helps Coleman.

Minnesota Law says that the certification can not be signed until the court election contest is completed. He is just following the law. I applaud him for that. That said, Coleman should not have filed the court contest, he is just delaying the inevitable at a cost to Minnesota tax payers.

21. This is one area where I disagree with what the Obama campaign did in the final days

Obama comfortably won Minnesota, by something like 400,000 votes, I think. It was decided in the last week of the campaign just to campaign in red states (plus PA)to gurantee as big a victory electorally as possible, which I understand and applauded at the time. But now, I wonder if it would have been good for Obama to have put in a couple of appearances in key blue states where there were closely fought senate races, like MN. Just to give a boost to somebody like Franken. All the polls showed it was going to be neck and neck in the Senate race, and perhaps if Obama had held one rally in the state it could have shifted 10,000 votes Franken's way and made this recount unnecessary. But who knows?
