Is there HOPE for Shepard Fairey?
The iconic image came from an AP photo and was used without credit or permission.

Well, I am not sure. I think there could be a problem.

1. If you change 66% of a photo's content it is legal. Andy Warhol did the same thing.
The Hope poster has more than a 66% change in content.

It is obvious that the AP is going after a little guy just like local news stations go after the local dry cleaner but leave the large corporations alone.

3. That is an interesting point.
Is "change in content" the general standard? I find this "controversy" interesting.

The "controversy" is trumped up.

If the AP thought they had the right to sue Shepard Fairey then they would have sued him.

Instead they decided to whine like bitches through the bully pulpit of their media empire.

2. I'd imagine so, yes. I think the changes are substantive enough
that it counts as a new, independent work.
