as if we needed more proof, where is scalia and gang rushing in to shut down the process so the people of minnesota can have the representation to which they are constitutionally entited.

one of the many arguments scalia made in his bush v. gore rationalization was that deciding who won the election simply could not wait. there was no time. well in advance of inauguration date, time had simply run out. knowing the victor of an election shortly after the election was somehow vastly more important than actually determining who got more votes.

yet in franken's case, we're now well past the january 3 swearing-in, and minnesotans are still short one seated senator.


yes, i know, there are different election laws, and yes, i know scalia cynically declared in bush v. gore that it's not a precendent for anything (ironically establishing a precedent for handing down precedent-free opinions), and yes, i know all his rationalization were crap designed to vaguely disguise a flagrantly political decision. but this makes it all the more clear that scalia and his gang are partisan operators and not "justices" in any real meaning of the word.

5. While I don't disagree with you,

the Supreme Court can't do anything to this process, because nobody's appealed it up to them yet. Heck, nobody's appealed it up to the MN Supreme Court yet, though Coleman probably eventually will after he stretches the current court process out as long as possible.

9. this is the big leagues, and there are back channel conversations all the time

if coleman were ahead at this stage one and the supremos were of a mind to stop it should the matter come to the court, word would have gotten from a scalia staffer to a coleman staffer and coleman's lawyers would have found a way to get the matter before scalia and the gang.

in the actual case, the supremos are not going to go all bush v. gore for franken's benefit, so he's left to go through the grinder.

6. Coleman is getting funds, and having the repigs speaking out for him

he has a commercial out with McConnell, Boehner and someone else who is saying Coleman needs to come back to the Senate.

Oh, I think Senator Franken will need some donations, I will try to scrape up something for him, the whole thing is sick, Franken is the winner. I hate republicans they are really showing what a$$es they truly are.

8. The Republicans strategy is to hold up a Al's conformation for as long as possible

to keep the democrats from getting closer to filibuster proof majority. I have to be honest and just say words fail me!
