Rulings have diminished Coleman's recount chances

Norm Coleman's chance of winning a recount appear to be diminishing, but he could be laying the groundwork for an appeal.



The Senate election trial is a month old, enough time to ask: Does Norm Coleman have a chance of winning?

A series of court rulings have dealt the Republican long odds for overturning DFLer Al Franken's 225-vote lead. The three judges hearing the case have been only partly receptive to Coleman's bid to expand the field of ballots as he seeks more votes, and they brushed aside his claim of systemic problems with Minnesota elections.

Coleman is in a bubble running out of oxygen," said Lawrence Jacobs, a University of Minnesota political science professor.

Coleman legal spokesman Ben Ginsberg reiterated late Friday that the campaign believes the candidate still can win enough votes from the current pool of rejected absentee ballots to win.

But the three experts who have been following the trial say Coleman also appears to be playing beyond the daily courtroom action and laying the groundwork for an appeal to the Minnesota Supreme Court or federal courts.

8. I know what you mean, but there aren't any torts involved here.
A tort is a common-law civil action in which one person has caused harm to another. Battery, false imprisonment, defamation, malpractice, etc. Tort reform usually means an attempt to change the process for torts, either (rarely) in the evidence required or (more commonly) in the types of redress available, such as in instituting a cap on the damages in malpractice lawsuits.

2. I suspect the Minnesota SC is the only real option
they have for further appeal when this fails. I believe the Federal courts would kick it back so fast their heads would spin.

3.  The whole point of the Coleman lawsuits is to deny us a 59th
vote. The GOP has very little hope of actually winning the seat. The RW cynicism know no bounds. Franken and the Democrats need to start calling them out for denying the people of Minnesota their rightful level of representation in Congress for the sole purpose of undermining President Obama's programs.

7. The appeals beyond the 3 judge panel won't stop Franken being certified
If Pawlenty refuses to certify after the 3 judge panel finishes, Franken has a MNSC case to force him to certify as the law states. There is no appealing of the certification beyond the 3 judge panel, so Franken gets seated as soon as they complete their work and render judgement.

17. I sure hope you're right.
I think the panel has bent over backwards to assure a more than fair trial.

If Coleman could take it Federal (though in another post you say he cannot), I imagine it would be over something ridiculously inane, the high court would send him & his lawyers to the woodshed.

Hmmm, I'd like to see them in the woodshed.

23. Coleman can certainly take it federal
It's just that Franken will have been certified when he does, so a fat lot of good it does him after Franken is seated.

5. IF he appeals to the Feds, Franken is seated
The haldout on Franken being seated is the challenge in state courts. When the state is done, Franken gets certified, so pushing to teh Feds doesn't do anything.

I really envy people who are enjoying following this case on a legal level, because it's making my eyes glaze over every time I read about it.

Say, why doesn't Obama do an end-around and appoint Coleman to HHS? It's risky, but if Coleman takes the bait and backs off on the Senate race, he'll almost certainly get thrown out on his ear during the confirmation process. It might work! He's not all that bright!
